Research On Anti-Monopoly Regulation Of Concentration Of Internet Enterprises Under The Digital Economy

Since the 1960 s,the rapid progress of information technology has led to the rapid expansion of the digital market,which makes the Internet industry develop rapidly all the way.With the advent of the digital age,Internet enterprises have become important participants in economic development.Digital economy accelerates the emergence and development of Internet leading enterprises.Foreign Internet leader "GAFAM"(Google,Apple,Facebook,Amazon,Microsoft)and Chinese Internet giant "BAT"(Baidu,Alibaba,Tencent)stand out from many competitive enterprises.The emergence of head Internet enterprises not only brings convenience to consumers,but also promotes the surge of malicious competition by making use of the dominant position in the market.In particular,the emergence of a large number of illegal concentration of operators in Internet enterprises has a great impact on the anti-monopoly regulation system of Internet enterprises in the era of digital economy.At present,M & A has become the main competitive behavior of Internet enterprises,which is full of in the whole process of enterprise development.The characteristics of digital economy,such as data core and technology drive,aggravate the network externalities and bilateral market characteristics of Internet enterprises,which makes it easier to form oligopoly after mergers and acquisitions.The monopolized Internet enterprises will not only stifle the existing and potential competitors,but also cause a series of adverse consequences,such as restraining industrial innovation,infringing upon the interests of consumers,affecting the freedom and diversity of the press and so on.The illegal concentration behavior of Internet enterprises under the digital economy is relatively covert.At the same time,there are situations such as unclear antitrust regulatory theories,inappropriate application thresholds,insufficient refinement of review systems,and conservative application of relief measures.Therefore,China’s current regulatory system is difficult to effectively regulate the illegal concentration of internet enterprises.Therefore,in the era of the digital economy,what theories should be adopted to regulate the concentration of internet enterprises,as well as how to further improve the declaration system,review system,and relief measures,have become the top priorities of antitrust supervision for internet enterprises.This paper focuses on "First,the particularity of digital economy and Internet enterprises.Second,the present situation of the regulation of concentration of Internet enterprises in China,Europe,and the United States.Third,the deficiency in the regulation system of China.Fourth,the perfection of the anti-monopoly regulation concentration of Internet enterprises under the digital economy" as a clue.First of all,determine the anti-monopoly concept that should be applied to regulate the concentration of Internet enterprises,analyze the characteristics of the digital economy and the characteristics of Internet enterprises,and reveal why Internet enterprises have become the focus of the current anti-monopoly regulation.Secondly,by explaining the antimonopoly system of concentration of Internet enterprises in China and analyzing the typical domestic cases,this paper reveals the current situation of the supervision of concentration of Internet enterprises in China.Thirdly,it explores the enlightenment of the extraterritorial anti-monopoly experience to China by explaining the legislative system of the concentration regulation of extraterritorial Internet enterprises.Finally,combined with the characteristics of digital economy and Internet enterprises,the paper points out the shortcomings of the existing regulation of concentration of undertakings in China,and draws lessons from the advanced system and effective experience of anti-monopoly regulation of foreign operator concentration.At the same time,combined with the existing situation of monopoly of domestic Internet enterprises,aiming at the specific problems such as declaration threshold,examination factors and relief measures,this paper puts forward the perfect path of operator concentration regulation which accords with the healthy development of Internet economy in China.
