The Empirical Research On Discipline Inspection And Supervision In Community Correction Field

As the execution of penalty changes from imprisonment to imprisonment and non-imprisonment,the number of community correction objects keeps increasing,the work tasks of the staff of community correction institutions keep increasing,and their independent power also keeps expanding.In this field,power-for-money trading,dereliction of duty and other problems have gradually emerged,and have become more and more intense.How to strengthen the supervision of public power in the field of community correction is an important task to be solved urgently.The supervision of the judicial administration department on community correction is the operational supervision within the system,which is difficult to be serious.The procuratorial organ’s legal supervision has no coercive force.After the reform of the national supervision system,the supervision of discipline inspection and supervision organs becomes a new start of in the field of community correction.From the result of the quantitative analysis of the performance of discipline inspection and supervision organs in the field of community correction,grassroots judicial offices become the "disaster area" of violation of discipline and crime in community correction field,the proportion of serious party and government disciplinary sanctions in community correction field is high,there are many cases of backward investigation and pursuit of responsibility after the incident,there are prominent problems of "micro-corruption",such as reception and entertainment consumption of the community correction objects in violation of regulations.The crime of abuse of power is the majority of the duty crimes,and the problems of violation of discipline,law and duty crimes run through every link of community correction.Among them,pre-trial investigation and evaluation,reward and punishment or relevant suggestions,and archives management are high-risk links.Delivery and reception,special fund management,asking for leave,and relationship roll-over and roll-out are medium risk links.Low risk links include declaration of correction,help and consolation,and treatment of violation of laws and regulations by community correction objects.Those are the reasons for the weak effectiveness of disciplinary inspection and supervision organs in the field of community correction,such as failure to intervene early enough,characterized by heavy work tasks and great pressure,low awareness rate of community correction work of the masses,lack of effective restraint measures for the objects of community correction,lack of standardized cooperation mechanism with the procuratorial organ,and the work mode does not adapt to the requirements of "intelligent community correction",the "dual" jurisdiction of duty crimes in the field of community correction reduces the efficiency.These are six suggestions to improve the quality and effectiveness of supervision of the discipline inspection and supervision organs,such as making relevant provisions of The Community Correction Law more clear,carrying out regular inspections by discipline inspection and supervision organs on the prevention and control of risks,the implementation of community correction object review mechanism,perfecting the combination of community correction object disciplinary measures,establishing a system of mutual assistance and achievement sharing with procuratorial organs,promoting intelligence level of supervision of discipline inspection and supervision organs in the field of community correction,clarifying the governing rules of discipline inspection and supervision organs and procuratorial organs.
