| The legal aid fund guarantee system is an important part of the legal aid system,because it involves whether the legal aid system can operate normally and develop well.Starting from the importance of the source of funds and allocation of funds in the fund guarantee system,this paper gives rise to the consideration of the shortage of funds and the unreasonable allocation of funds.Then,by enumerating the total amount of legal aid funds,the growth rate,the total number of handling cases and other data from 2005 till now,this paper analyzes and demonstrates the unreasonable source of the single source of legal aid funds and the unreasonable distribution of funds within organizations in different regions,different case properties.Based on the experience of legal aid system reform in Germany,Britain and other countries,and combined with our legal aid system,the diversified mechanism which is dominated by increasing government appropriation,supplemented by legal aid litigation insurance system and exceptional by rural collective part donation is put forward to alleviate the problem of shortage of legal aid funds.We will flexibly adjust the flow of resources(capital input and human resources)between eastern,central and western regions,the multi-track fund guarantee for the measurement of legal interest value,and increase the proportion of case handling funds,so as to properly adjust the allocation of funds between different regions,cases of different nature and within institutions.Finally,we can improve the utilization rate of funds by strengthening the supervision of fund flow,so as to protect the legitimate rights and interests of vulnerable groups. |
