A Research Of Difficul Implementation In Civil Case

At present,in the judicial practice of the people’s court,the difficult execution of civil cases is still a common existence.As the best defense of fairness and justice,the difficult execution has greatly damaged the credibility of the judiciary and the image of the people’s court.Over the years,although the people’s courts have been increasing investment in solving the problem of difficult execution,the problem of difficult execution of civil cases has not been completely resolved,and it is still a big problem in the work of the people’s courts.In this paper,the author classifies the difficulty of execution,lists the achievements of the people’s court in solving the difficulty of execution,and finds out the implementation difficulties existing in the execution of civil cases through concrete and vivid cases,analyzes the causes of the difficulty of execution deeply,draws on the practical experience at home and abroad,and puts forward feasible solutions.The specific content of this paper is as follows:In the first chapter,the author elaborates the significance of the topic in combination with her own work,analyzes the present situation and deficiency of research at home and abroad,and determines her writing focus and innovation point of this paper,and finally determines her own research methods and steps,which clarifies the direction for the next step of writing of this paper.In the second chapter,based on the types of civil case execution,and according to the characteristics of the difficulty of civil case execution,the difficulty of civil case execution is divided,which lays a foundation for the subsequent problems and solutions of the difficulty of civil case execution.In the third chapter,this paper elaborates on the achievement which our country obtains at present stage in solving difficulty of civil cases execution,and it is also the explanation of the background of difficult execution of civil cases discussed in this paper.In the fourth chapter,combined with the author’s actual work and typical cases,this paper lists the problems existing in the execution process of civil cases,such as the lack of enforcement legislation,insufficient executive force and so on,analyzes the cause of the difficulty of our civil execution,determined the reasons of legislative level,court level and social level.In the fifth chapter,on the basis of pointing out the problems,the advanced experience of Chinese Hong Kong,Chinese Macao,Chinese Taiwan and foreign countries is listed to put forward the solution measures and provide reference basis for the following chapters.In the sixth chapter,based on the analysis above,the author puts forward her own idea of solving the difficulty of execution in civil cases,that is,through the enforcement of legislation,executive measures,executive management,public opinion guidance of execution,and construction,optimization and improvement of credit system,to jointly solve the difficulty of execution.
