The Friendly View Is Integrated Into The Interpretation Of Civil Judgment Documents

In recent years,core socialist values have been written into many laws and regulations.In response,the Supreme People’s Court also issued relevant guidelines,explicitly requiring judges to integrate the socialist core values into the interpretation of the judgments,so as to improve the acceptability of the judgment results and promote the positive energy of society.As the "greatest common divisor" of all the values in the civil judgment documents,which helps to give full play to the role of judicial judgment in the rules and value guidance in national and social governance,and enhance the credibility and authority of judicial judgment.We will combine legal evaluation with moral evaluation so that both parties can accept the results from their hearts and make the people feel fairness and justice.As the value criterion of citizens’ individual level,friendly view is the basic compliance of interpersonal relationship,with rich connotation and far-reaching significance.It is an important entry point for the integration of socialist core values into the interpretation of civil judgment documents.The concept of friendship has three connotations of helping others,being tolerant and treating nature well.It not only inherits the excellent traditional Chinese culture,but also learns from the beneficial achievements of other civilizations,and also reflects the essential requirements of socialism.Integrating the friendly view into the civil judgment documents can promote the value of friendship,weaken the rigidity of the interpretation of the civil judgment documents,and improve the quality of reasoning.Through 209 contains friendly view into the interpretation of the civil judgment of empirical analysis,combined with the relevant guidance case and vigorously carry forward the socialist core values of typical cases,found that the current friendly view into civil interpretation reasoning into the written judgment when the lack of pertinence,friendly reasoning and interpretation of disconnection,friendly reasoning and interpretation reasoning relationship unknown,friendly reasoning instead of judgment,into the rigid and flexible,integrated reasoning evaluation mechanism needs to be refined.The existence of these problems weakens the acceptability of the interpretation of civil judgment documents,which is not conducive to the educational role of civil judgment documents.Enhancing the authority of reasoning;proper rhetoric and improving the effect of reasoning;finally,evaluate the quality of the friendly view by setting quantitative evaluation indicators to ensure the quality of reasoning.At the same time,judges can timely improve the reasoning according to the evaluation opinions,and can also provide specific methods and guidance for integrating other values of socialist core values into the interpretation and reasoning in civil judgment documents.
