On The Relationship Between Our Righteous Values And Legal Liability

As a very important part of Chinese social values,the value of kindness has played an important role in Chinese interpersonal communication since ancient times.Through the analysis and comparison of the meaning of the values of kindness in Chinese history and the contemporary meaning,it is found that the meanings of the values of kindness in ancient and modern times have changed,but the values of kindness,as a traditional Chinese value concept,still continue its value in contemporary China,consistent with the guidance of socialist core values.From the value of righteousness and legal responsibility analysis,it is found that the values of kindness and legal responsibility in our traditional legal culture have interwoven,reflected in the advocacy of righteous courage and the punishment of seeing danger,"false accusation and reverse sitting" is a punishment way to blackmail the rescuer;Our current law has about the embodiment of "brave" and "ungrateful",but the lack of "see danger" responsibility provisions.There is a cross between moral responsibility and legal responsibility in the violation of the values of righteousness.There is a moral embodiment in legal responsibility,but there is a difference between moral responsibility and legal responsibility.In the process of advancing comprehensively the rule of law in our country,the values and legal responsibility of righteousness should be mutually promoted and coordinated.Through the analysis of the cases that harm the values of justice in our society in recent years,it is found that there are the lack of relevant legislation: first of all,the lack of legislation on voluntary felon-fighting,second,the lack of legislation on seeing the danger,third,the lack of reasonable judicial explanation for the responsibility of the ungrateful,and finally,the lack of legal regulation on the public opinion of the network media.In the judicature of related cases,there are some problems,such as the judge’s decision not strictly based on the burden of proof and the lack of a positive response mechanism to the society in the judicial opening system.The reasons for the above problems are both academic and social.For the conflict between the values of kindness and legal responsibility,we should attach importance to the values of kindness in the perfection of laws,and transform part of the values of kindness into legal responsibility in legislation,so as to strengthen citizens’ values of kindness through law and reduce the occurrence of moral decline in society.
