With the development of network technology,short video platforms are booming,and the increase in the number of short video platforms increases the possibility of privacy infringement,which has a far-reaching impact on minors.How to better protect the privacy rights.After sorting out the existing protection contents in China,it is problems in China: first,in legislation,the concept in civil law is unclear,the protection rules are not systematic,and the way and scope of protection are not clearly put forward;In the law on the protection of minors,there are no judicial protection regulations to guide practice,grass-roots protection is not covered,and law enforcement efficiency is low.Secondly,the relief method of the obligee is not specific,the burden of proof is unclea.Third,industry self-discipline norms have little effect on the management of short video platforms,technical protection has loopholes,and supervision and punishment measures are not strict.Fourth,the guardian’s responsibility,the guardian’s protection ability is poor.The problems lie in the hidden and complicated privacy policy,the lack of choice of guardian’s protection mode for minors,and the expansion of the scope of parental authorization.Through the comparative analysis of this rights are clarified,the definition of online privacy rights is explained,and the ways to protect online minors’ privacy rights are formulated,it is necessary to implement the judicial basis,build a national protection network covering the grassroots,and improve the efficiency of law enforcement.Secondly,in judicial protection,we should unify the handling mechanism of the procuratorate,clarify the burden of proof,improve the relief methods,and grasp the boundaries between privacy and the right to know.Third,industry self-discipline,in the field of short video to develop a unified self-discipline norms,using a combination of manual and technical review,multi-channel supervision.Fourthly,in terms of guardian’s responsibility,the privacy clause should be put in front of the short video registration,the guardian’s awareness should be improved,the age stratification should be set in the "youth model",and the informed consent system should be strengthened for minors.To sum up,China needs legal regulation,platform self-regulation,family management and other multi-subjects,with the guidance of typical referee cases,to protect minors’ online privacy to the maximum extent.Guarantee the future development of short video platform and minors through improving suggestions.
