Research On The Legal Issues Of Water Right Trading In The South-to-North Water Diversion

Water is an important natural resource that plays an important role in the progress of mankind and the development of society.The middle route of the South-to-North Water Diversion Project is an important cross-basin water transfer project in China,which is of great significance to solving the current water shortage problem in the north.With the development of the city scale in the Beijing-Tianjin wing area,the construction of Xiong’an New Area and the implementation of the strategy of the rise of central China,the accelerated development of urbanization,industrialization and agricultural modernization,the continuous increase in water resources,water shortage has become the main factor and important bottleneck restricting the economic development of Henan and Beijing-Tianjin-wing areas.In order to ensure the demand for water supply,the over exploitation of water resources in some areas has approached or exceeded the carrying capacity of water resources in the region,and it is urgent to revitalize water reserves through water rights trading and solve the problem of water shortage to meet new water demand.Therefore,how to rationally optimize the allocation of water resources for the South-to-North Water Diversion Project is a major problem facing us at present.At present,the demand for water resources in the area through which the middle route of China’s south-to-north water diversion passes far exceeds the total amount of water resources,so it is imperative to improve and optimize the trading system for water rights for south-to-north water transfer.However,the water rights trading of the middle route of the South-to-North Water Diversion Project is different from that in other regions,and its main purpose is to benefit the people,based on solving the drinking water problem of the people in the northern region,and its water flow and water resources reserves are not as good as those in natural river basins such as the Yellow River and the Yangtze River.Therefore,its water resources are more valuable,and its water rights trading should be comprehensively and meticulously improved,so that its water rights trading is more flexible and more scientific and reasonable.Improve the trading system for water rights for the South-to-North Water Diversion Project,give full play to the value of the South-to-North Water Diversion Project,and make full use of the water resources of the South-to-North Water Diversion Project to achieve the goal of benefiting the people of the project.After the division of water rights in the middle route of the South-to-North Water Diversion Project,the main problems in the legal norms of the water rights trading market are: weak vitality of the water rights trading market,imperfect water rights trading platforms,unclear confirmation of water resources rights for the South-to-North Water Diversion Project,and imperfect supervision and management systems for the water rights trading market.This paper summarizes the experience of the water rights trading market in the Yangtze River and Yellow River Basins,the experience of water right trading in foreign water diversion projects and the pilot experience of water right trading in the middle route of the South-to-North Water Diversion Project,and puts forward corresponding strategic suggestions for the above problems: improve and improve China’s water rights trading system;development of local regulations in this regard;Clarify the initial allocation of water rights for the South-to-North Water Diversion and solve the problem of confirming the rights to water resources in the South-to-North Water Diversion;Expand the water rights trading platform,build a unified water rights trading system,establish a national cross-basin water rights trading market,improve the water rights trading platform,and promote the relative centralization of water rights trading;Weaken the state’s control over the water rights market in local cities,and strengthen the vitality of the water rights trading market in local cities;Establish a "reservoir and water bank system" to avoid wasting water targets,etc.Make modest efforts to build a south-to-north water transfer water rights trading market and even a national water rights trading market.
