Data Power Regulation In Emergency Rules

The outbreak of COVID 19 in 2020 had seriously threatened human beings’ health.In order to control this epidemic,Chinese provinces and cities had used health codes as an important means.A bank in Henan Province,however,gave red codes to depositors in June 2022.The incident exposed the fact of abusing the assigning and transforming health code power,which aroused high attention from society and academia.Health code is a digital method that combines health information with data,and eventually uses different colors to represent risk levels.The power of assigning and transforming health code belong to both emergency power and data power.The expansion of data power,the particularity of emergency power,the protection of civil rights and the basic law principles all require to regulate this power.Through empirical analysis,however,some problems are found: low effectiveness,lack procedural rules and insufficient citizens’ rights relief.Therefore,this paper intends to regulate the power by formulating unified rules,adding procedural rules and multiplying relief methods.Only in this way can we protect citizens’ rights and promote national capacity in emergency.
