Religious Medicine constitutes a significant aspect of religious matters.The exploration of legal issues pertaining to Religious Medicine is indispensable in adhering to the sinicization of religious management,actively steering religion to adapt to a socialist society,and enhancing the rule of law in religious affairs.Globally,Religious Medicine objectively exists,including within our country.Its prominence is even more pronounced in certain ethnic areas,rural regions,and remote boarder area,yet the related research remains scant.Although sporadic studies exist within domains such as cultural studies,ethnology,and anthropology,research regarding the rule of law within this field,particularly systematic elucidation,is notably absent.Religious medicine,conceptualized as a spiritual phenomenon and a form of medical practice,fundamentally represents spiritual governance.The crux resides in the scientific employment of legal tools.This warrants an approach rooted in spiritual philosophy,whereby empirical and normative analyses of religious medicine phenomena are undertaken to rationally sketch and demarcate their legal coordinates.This approach undoubtedly offers a potent template,both in theoretical paradigms and practical experience,for advancing the rule of law in religious affairs and hastening the progression towards legally regulated medical treatment.This research employs methodologies including literature review,field surveys,comparative analysis,and case studies to rationally frame the concept of religious medicine.It aims to elucidate the relationship between ethnic medicine and religious medicine,and to probe the pathway towards the sustainable development of ethnic medicine.Simultaneously,by reviewing the current status of the rule of law in religious medicine,it is posited that it presents considerable challenges to the preservation of the right to life and health.There is an urgent need to explore a scientific rule of law trajectory,grounded in principles that place science above religion and national law above religious doctrines.In particular,guided by Xi Jinping Thought on Rule of Law,we propose the following suggestions for the rule of law path in faith-related healthcare,spanning across five distinct areas:Firstly,we need to optimize and improve the regulatory system related to faith-based healthcare.We should make good use of local legislative powers,introduce local management regulations,bring faith-based healthcare into the orbit of legal governance,leverage the role of soft law and customary law,and effectively fill the gaps in hard law pertaining to faith-related medical fields.Secondly,we need to strengthen the construction of the rule of law and intensify its promotion.This can be achieved by establishing grassroots legal propaganda teams,innovating ways of propagating law,and carrying out targeted and precise legal publicity,thus creating a strong atmosphere of governing education and healthcare in accordance with the law.Thirdly,we should enhance our grassroots healthcare personnel,especially in the cultivation and allocation of medical law talents.This enhancement will increase the treatment capabilities and governance standards of grassroots medical institutions,thereby ensuring comprehensive treatment of common and multiple diseases at these facilities.Cultivating trust among the public for grassroots healthcare institutions,advocating rational perspectives towards diseases,and promoting scientific and orderly treatment is also crucial.Fourthly,it is important to protect the rights of the people to life and health.This can be achieved by strengthening the safeguards for the right to life,improving the rural healthcare security system,enhancing the humanistic qualities in medical treatment,intensifying humanistic care in modern medical treatment,and strengthening psychological counseling and comfort for patients.This way,patients can positively face their illnesses,cooperate with modern medical treatment,recover their health promptly,and effectively ensure their rights to medical treatment and health.Fifthly,we need to strengthen the supervision and management of medical law enforcement.This includes lawfully cracking down on illegal faith-related medical activities,intensifying faith-based health law enforcement,and ensuring the standardization and legality of medical practices in faith-related settings.
