| Organ donation and transplantation are great innovations in the history of 20th-century medicine,representing a landmark in the modern medical field.Over the past few decades,organ transplantation technology in China has continuously developed and been in the international leading place.Remarkable results also have been achieved in the field of human organ donation.Currently,China has established five major organ donation and transplantation systems,including organ donation,acquisition and allocation,clinical services and quality control of organ transplantation,and supervision of organ donation and transplantation.According to the latest data from the China Organ Donation Administrative Center,as of March 2023,volunteers registered for human organ donation in China have exceeded 6.15 million,with over44,000 cases of human organ donation and more than 130,000 donated organs.Since 2016,China has ranked second globally and first in Asia for human organ donation after death.However,compared to many countries and regions that already have well-established organ donation legal systems,China’s legislation on organ donation is relatively lacking,primarily relying on the “Regulation on Human Organ Transplantation” issued by the State Council.Due to influences such as traditional culture and social norms,legislation regarding organ donation and transplantation is controversial and challenging.The lagging legislation is no longer able to meet the rapid development needs of the organ donation and transplantation field.On August 22,2018,the first case of human organ donation in the Tibet Autonomous Region was successfully performed,marking a milestone in the organ donation work on the Tibetan Plateau.It is noteworthy that although there has been extensive research on the legal issues of organ donation in various provinces and cities in China,there is limited mention of the legal issues surrounding human organ donation in the Tibet Autonomous Region due to their traditional culture,religious customs,and the low level of public understanding of organ donation,which circumscribes the development of organ donation in Tibet.Based on the different studies of organ donation legal systems at home and abroad,this research aims to discuss and analyze how to learn from and draw on advanced legislation and operational models of foreign countries in the field of organ donation.It also takes into account the current status and problems of organ donation work in China and researches the issues of human organ donation in Tibet.The goal is to explore the path to improve the legal system of organ donation and promote its legalization in Tibet.This research is divided into five parts: the first part provides an overview of human organ donation,explaining the concept,analyzing its definition,characteristics,and legal nature,while also analyzing the legislation on organ donation in China and abroad.The second part reviews the basic situation of human organ donation work in China,including the legal system,the framework of organ donation,and the workflow,and summarizes the main issues currently faced in organ donation in China.The third part analyzes the current situation and issues of organ donation work in Tibet Autonomous Region through statistical data,comparative analysis,and other methods.The fourth part analyzes and assesses the reasons hindering the development of organ donation cause in Tibet from different aspects.The fifth part proposes countermeasures and suggestions to promote the sustainable and healthy development of organ donation work in the Tibet Autonomous Region. |
