China’s Green Credit Legal System Under The "Double Carbon" Strategy Research On Green Credit Legal System

Excessive emissions of greenhouse gases have led to global climate change and the intensification of the greenhouse effect,which in turn have caused an increase in climate disasters and aggravation of natural disasters.As a major component of greenhouse gases,reducing CO2 emissions is the most effective means to mitigate global climate disasters at this stage.In the context of global low-carbon and national carbon-reduction,General Secretary Xi Jinping proposed a "dual-carbon" goal at the 75 th General Assembly General Debate.By now,the "dual carbon" target has become a key strategic goal for China’s development in the 14 th Five-Year Plan period and even in the medium and long term,and the "dual carbon" strategy has also become the key to the development of green credit.The background of the times.On this basis,green credit,as one of the important financial tools to promote the realization of the "dual carbon" strategy,is bound to play its due role in the process of achieving the "dual carbon" goal.But how can green credit better play its role in the process of achieving the dual carbon goal? From the perspective of the rule of law,it requires a sound legal system to regulate and guide the rapid development of green credit.This paper adopts a historical analysis and case study approach to study the legal system of green credit in China under the "dual carbon" strategy based on the legislative practice of green credit in Shenzhen,Shanghai and Quzhou,and makes corresponding suggestions for improvement.This paper mainly includes the following parts:First,this paper analyzes the dialectical relationship between the green credit legal system and the "dual carbon" strategy and its mechanism of action,and analyzes the development trend and practical utility of the green credit legal system in the context of the "dual carbon" strategy.In the context of the "double carbon" goal,green credit,as an important financial tool to promote the transformation of China’s real economy,plays an irreplaceable role in the high-quality development of China’s green industry.Secondly,by combing the development history of China’s green credit policy and summarizing the characteristics of the development of China’s green credit policy in each period,the author selected Shenzhen,Huzhou and Shanghai,which were the first to introduce local regulations on green finance in China,and sorted out the green credit legislation featured by these regions.In the light of the current institutional needs for the realization of the "double carbon" strategy,we summarize the shortcomings of China’s green credit legal system under the "double carbon" strategy,such as relying on policies and normative documents to promote,and the lack of legal coercive power;the lack of commercial banks There is a lack of regulations on corporate responsibility and environmental responsibility of commercial banks,and a lack of carbon reduction and low-carbon regulations.Finally,in order to improve the legal system of green credit in China,we refer to the experience of foreign countries in building the legal system of green credit,and combine the green and low-carbon characteristics of the "double carbon" goal,and put forward suggestions to improve the legal system of green credit in China under the "double carbon" strategy.Firstly,the specific environmental legal responsibilities of green credit in civil,administrative and criminal aspects should be clarified.Secondly,the law should improve the information disclosure system of green credit,clarify the rights and responsibilities of all parties involved in green credit,and improve the credit supervision system of green credit.Third,set up low-carbon and carbon-reduction provisions in the law to connect the "double carbon" target with China’s green credit legal system.
