The Development Logic Of People’s Mediation From The Perspective Of "Integration Of Family And Country"

People’s mediation in history has gone through the process of origin,birth,development and reconstruction,and has begun to show a momentum of revitalization in the new era.However,the revitalization effect of people’s mediation is not ideal as far as the actual situation of dispute settlement by people’s mediation is concerned.People’s mediation is also being discussed in theory and practice,but it is difficult to get out of the dual opposition frame of judicature-mediation under the influence of judicature.or from another point of view,they often make two relatively extreme judgments on the development orientation of people’s mediation,that is,either the pan-administrative development orientation of "similar to judicial" and "judicature mediation",or the idealized autonomous development orientation.However,people’s mediation should actually have the dual attributes of the state and society.It has both the judicial attribute of contradiction and dispute resolution and the social attribute of multiple governance.Both forces should be present.If we only discuss the simple dimension of strength or weakness,we will ignore the duality that people’s mediation should have.Inspired by Zhou Feizhou’s research on the relationship between the state and farmers from the perspective of the integration of the family and the state,and combined with specific cases,this paper makes an understanding and analysis of the duality and development logic of people’s mediation.First of all,through the review of the evolution process of people’s mediation,understand the profound connotation of people’s mediation in different historical stages,and then analyze the development connotation and development logic of the current stage of people’s mediation.Secondly,combined with the specific case of "Heshun Teahouse" in S District,C City,this paper analyzes how this innovative practice meets the requirements of the current country and society for people’s mediation and activates the function of people’s mediation.Specifically,Heshun Teahouse realizes the convergence of multiple subjects through the physical image of "teahouse".Through panoramic community construction reflects the tension of "local knowledge";By means of "drinking tea to relieve anxiety" and "putting on a front door",as well as procedures such as "people’s meeting" and "eighteen tea courses",the people’s mediation achieves autonomous function and social function from multiple dimensions such as subject,object,mechanism and norm,so as to realize the docking between the state and individuals under the background of the new era.Finally,based on the analysis of innovative cases,this paper tries to abstract the innovative mode of people’s mediation with Chinese characteristics.At the bottom level of development value,the development logic of people’s mediation needs to be grasped in the "duality of home and state" or the interaction of home and state.On the level of specific methodology,the development of people’s mediation needs to establish a positive interaction channel between the country from the structure,and cultivate the endogenous culture of the integration of the country and the country from the level of value,so that people’s mediation can be revitalized in the current social background.
