| Along with the continuous upgrading of market competition,trademarks are becoming diversified.Trademarks are no longer limited to the traditional forms such as text and graphics,and the non-traditional trademarks such as sound,tactile mark and smell are gradually coming into the public’s view.Although China has established the registration system for sound trademarks since 2014,there still exist problems about the distinctiveness of sound trademarks in the legal provisions and system design,which may lead to difficulties in both legislation and practice.Against this background,this paper aims to put forward practical suggestions on the distinctiveness system for sound trademarks.With the documents analyses,the comparative study and the case study,this paper analyzes the existing problems in the distinctiveness of sound trademarks in China.In addition,it also contrasts the systems for sound trademarks in the Unites States,the European Union and Australia.By summing up the valuable experience from these areas,this paper proposes practical measures to solve the inadequacies for chinese sound trademarks system. |
