With the rapid development of information technology,a variety of new employment forms continue to emerge.The emergence of the novel coronavirus pandemic has attracted wide attention to the flexible employment of telecommuting.Its unique working mode makes it the best way to promote the orderly resumption of work and production of all industries during the epidemic period.However,the characteristics of telecommuting also make employers often use a variety of hidden,intelligent monitoring means,monitoring workers’ working environment,email exchanges,instant messaging equipment,whereabouts and track,in order to maintain their own property interests,ensure the purpose of labor efficiency.The subordinate nature of labor relations makes workers enjoy incomplete privacy rights compared with ordinary natural persons.The characteristics of telecommuting make the work of telecommuting workers closely connected with their personal lives,and the workers themselves are relatively lacking in network security protection ability.The above behaviors of employers undoubtedly make the privacy rights of telecommuting workers face greater threats.Thus exacerbating the imbalance in labor relations.In the information age,telecommuting is bound to become an important form of employment,and the privacy of workers is related to the personal dignity of workers,which is an important content that cannot be ignored in the protection of legitimate rights and interests of workers in the future.Therefore,starting with the basic connotation of telecommuting,this paper analyzes the existing problems of the legal protection of the privacy right of telecommuting workers in our country,and discusses the relevant provisions of the protection of the privacy right of telecommuting workers in foreign countries such as Europe and the United States.We can first clarify the scope and basic principles of remote workers’ privacy protection by improving existing labor laws and regulations such as the labor contract law.Then,on the basis of strengthening the supervision responsibilities of labor supervision departments and the rights protection power of collective organizations such as labor unions,we can strengthen the main responsibilities of employers and strengthen the ability of network security protection and other relief channels for remote workers.To gradually improve the necessary measures to protect the privacy of remote workers and promote the improvement of the legal protection system of the privacy of workers.
