Soft Law Regulation Of Rural Social Disputes

Rural governance is the cornerstone of national governance,but also the foundation of rural revitalization.In recent years,with the continuous advancement of the rural revitalization strategy,the rural society has shown a trend of high-quality and efficient development trend in various aspects such as politics,economy,and culture.At the same time,the issue of rural social disputes has become more and more serious,greatly affecting the normal production and life of villagers and the harmony and stability of rural society.How to effectively regulate them is an important topic that needs in-depth study at present.Soft law is a legal norm that can embody democratic consultation and public participation,and does not depend on the enforcement of the state.With the advantages of low regulation cost,more flexibility and diversity,and better regulation effect,soft law regulation is undoubtedly the best choice to regulate rural social disputes.In view of this,this paper takes the regulation of soft law in rural social disputes as the research object,based on the research results of rural social disputes and soft law,uses empirical research,comparative analysis and literature research methods to try to prove the advantages of soft law in regulating rural social disputes in a more comprehensive way,and puts forward the problems and solutions of soft law in regulating rural social disputes in a targeted way,so as to further realize the rule of law in rural society,Promote the new process of rural revitalization strategy.In addition to the introduction and conclusion,this paper is divided into four parts.The first part is a detailed introduction to the basic concepts of rural social disputes and soft law,which lays the foundation for the following discussion.The second part discusses the theoretical basis and value of soft law in regulating rural social disputes.First of all,it is concluded that the soft law regulation of rural social disputes has the profound theoretical basis of legal pluralism theory,legal self-generated system theory,public governance theory,and consultative democracy theory;Secondly,it introduces the superior value of soft law in regulating rural social disputes compared with other ways of regulating rural social disputes.The third part is the current rural social disputes soft regulation of the status quo and the existing problems.First of all,combining with the specific situation of the on-the-spot investigation,we will sort out the present situation of soft law regulation of rural social disputes in China from the basis of soft law norms and multiple subjects,implementation methods and implementation methods.It summarizes the existing soft law regulation problems in four aspects: imperfect soft law basis,defective subject,obstacles to implementation and inadequate environmental protection.In the fourth part,the author puts forward corresponding suggestions to solve the existing problems of rural social disputes.In view of the problems in the regulation of soft law on rural social disputes mentioned above,this paper makes an improvement from four aspects: perfecting the normative basis of soft law regulation,making up the defects of the main body of regulation,removing the obstacles in the implementation of soft law regulation,and strengthening the environmental protection of soft law regulation.
