Study On The Standardization Of Housing Security System Based On The Right Of Habitation

Ensuring that all people have a place to live is the top priority of the Communist Party of China and China’s livelihood protection.In order to achieve this goal,China has successively established several kinds of housing security systems for renting or allocating in kind.Property-type affordable housing provides ownership of houses,which far exceeds the actual needs of housing security,resulting in local governments facing problems such as inefficient security,land shortage and financial pressure.Rental affordable housing has defects such as the inability to provide stable housing expectations for the insured and insufficient protection of rights.In addition,China has not yet introduced a high-level law to adjust the relationship between housing security,and the function of the housing security system has not been fully brought into play.The existence of the above problems shows that China’s housing security system is in urgent need of innovation and improvement.The right of habitation stipulated in the Civil Code of the People’s Republic of China provides new ideas for the standardization and legal development of the housing security system.The introduction of the right of habitation,which has the nature of a usufruct right,into China’s housing security system can overcome the lack of stability and flexibility of traditional housing security methods.In the introduction part,this paper mainly sorts out the research status of habitation rights,housing security and housing rights at home and abroad,summarizes the research gaps in the above fields,in order to focus on them later.The first chapter introduces the current situation of China’s housing security system,divides the types of housing security methods,summarizes the disadvantages of the two types,and puts forward the problems of China’s housing security system.The second chapter demonstrates the connotation of human rights protection and the characteristics of the right of habitation,and concludes that the right of habitation is compatible with the development of China’s housing security system.The third chapter examines the necessity and feasibility of introducing habitation right into housing security systems and responds to questions about whether the concept of private law can be introduced into the field of public law.The forth chapter puts forward the concept of the social security habitation right,based on which China’s housing security system can be completed.And then the constitutional basis for the social security habitation right is founded,with the basic principles and specific content of the social security habitation right clarified.Through the above research,this paper preliminarily constructs a standardization approach to China’s housing security system,and provides theoretical support for China to achieve the goal of adequate housing for everyone.
