Research On The Course And Experience Of The Chinese Communist Party To Administer The Country According To Law

After the Third Plenary Session of the Eleventh Central Committee of the Party,the Party led us on a new journey of building democracy and the rule of law.The Party’s 15 th National Congress laid down the basic principles for the rule of law.The Fourth Plenary Session of the 18 th Central Committee of the Party held its first thematic discussion on the topic of the rule of law.In 2017,the Central Committee established the Leading Group for the Comprehensive Rule of Law.In 2018,the Committee for the Comprehensive Rule of Law was established.Adhering to the organic unity of the Party’s leadership,the ownership of the country by the people and the rule of law,and ensuring the modernization of the country’s governance system and governance capacity through the constitutional legal system have pushed the rule of law to a new and unprecedented level.Rule by law is the basic strategy of our Party to lead the people in governing by law.Building a country under the rule of law is an important goal of our Party’s political construction.Xi Jinping,General Secretary of the Communist Party of China(CPC),chaired a meeting of the Committee on the Comprehensive Rule of Law in Beijing from October 16 to 17,2020,to study major issues of the rule of law and review the course of the Party’s overall rule of law since the 18 th National Congress,especially its historic achievements.Therefore,it is of great theoretical and practical significance to comb through the glorious process of the Party leading the people to govern according to law since the reform and opening up,and summarize the basic experience of the Party leading the country according to law.First of all,this paper introduces the reason and significance of the topic of rule by law,the current situation,the thoughts and methods of the research.And through the reform and opening up to the legal system since the third plenary session of the eleventh central committee of the work of the party since the shift to economic construction,correction,political construction,market economy development four aspects of the importance of the party leadership to comprehensively rule the country according to law,and the need for the leadership of the communist party to rule the country according to law.According to the continuous improvement and advancement of the Party’s legal system construction in the early stage of reform and opening up,the Party divided the construction of the legal system into three stages,namely the restoration stage,the transformation stage and the flourishing stage,and systematically combed the historical process of the Party’s leadership of the legal system construction.During the period of restoration,we have achieved legislative revival,judicial revival and development,popularization of the rule of law education and,in particular,the restoration of the concept of the rule of law,which was destroyed during the Cultural Revolution.During the transition from the "rule of law" to the "rule of law",the communist party of china has established a strategy to govern the country according to law,requiring governments at all levels to administer justice in accordance with the law,and at the same time to step up legal education for society.Since entering the new era,the theory of the Party’s comprehensive rule of law has been deepened,"comprehensive rule of law" has been incorporated into the "four comprehensive" strategic layouts,and comprehensive rule of law has been taken as an important guarantee for the realization of socialist modernity.Finally,the article summarizes the experience of the Party leadership in ruling the country according to law through four dimensions: legislative,executive,law-abiding and judicial.Our party’s exploration of the construction of the rule of law shows the institutional advantages of socialist rule of law construction with chinese characteristics,and also makes the leadership of the party the greatest feature,advantage and most resolute political guarantee of the construction of the rule of law in our country.Since the Eighteenth National Congress,the Party Central Committee has proposed a great strategic approach to comprehensively promote the rule of law,formulated a series of major decisions and arrangements,formed Xi Jinping’s thoughts on the rule of law,and put forward new demands on the Party leadership to govern by law and new guidelines for action.Therefore,it is in our interest to further strengthen our sense of mission,era and responsibility to govern the country according to law in an all-round way by sorting out the overall historical development of the Party leadership since the reform and opening up.
