Research On The Application Of The Compulsory Reporting System In Case Of Violation Of Minors

At present,cases of violations against minors in our country are frequently occurring,and the problem of sexual violations is particularly prominent.In judicial practice,cases against minors are generally characterized by a high proportion of acquaintances,younger victims,and the Internet becoming a new way of infringing minors,which makes such cases difficult to prevent and discover.Based on early detection and early prevention,the establishment and continuous improvement of the compulsory reporting system for cases against minors has become an important part of our country’s special protection system for minors.The doctrine of state parental authority and the principle of the best interests of the minor together justify the jurisprudence of the mandatory reporting system.After going through three stages of top-level policy design at the national level,pilot testing by local procuratorial organs,and formal establishment at the specialized system standard level,the "Opinions on Establishing a Compulsory Reporting System for Violation Against Minors" systematically stipulates the content of the compulsory reporting system for minors from six aspects: responsible subject,scope of application,reporting method,responsibility for failure to report,provisions on protection of responsible subjects,and coping and response mechanism.However,in the specific application,there are still problems such as the weak reporting awareness of the responsible subject,the imperfect reporting system,and the imperfect configuration of the institutional support mechanism.Comparing the experience of the United States,Australia,Canada,Chinese Taiwan and other countries and regions that established the mandatory reporting system earlier in terms of applicable situations,reporting mechanisms,and response mechanisms,our country’s the compulsory reporting system for minors also needs to be further improved from four aspects: policy and rule of law advocacy for compulsory reporting,the scope of application of compulsory reporting,the systematic improvement of the compulsory reporting system,and the construction of a comprehensive minor protection response mechanism.To promoting the effective implementation of the compulsory reporting system for minors,and then establish a legal system project for the comprehensive protection of minors in our country.
