Research On The Legal Regulation Of Traffic Fraud In The Live Broadcast E-commerce Industry

When the live broadcast e-commerce industry is booming,the problem of traffic fraud is also becoming more and more serious.The proliferation of false traffic will not only damage the legitimate rights and interests of relevant stakeholders such as consumers and honest operators,but also lead to "bad money drives out good money".The phenomenon of reverse elimination will hinder the healthy development of the live broadcast e-commerce industry,and ultimately affect the entire market competition mechanism and the Internet economic ecology.Therefore,there is an urgent need for effective legal regulation of traffic fraud in the live broadcast e-commerce industry.In order to seek a legal regulation path to govern traffic fraud in the live broadcast e-commerce industry,first of all,it is necessary to clarify which participants are in the live broadcast e-commerce industry,and then analyze the cooperation models that exist among the participants,and define their role in different cooperation models.Legal subject status,and then,on this basis,use the method of legal interest analysis to analyze which legal relationships are involved in different cooperation models,and in each legal relationship,their rights and obligations arising from traffic fraud,the content of responsibility.Secondly,by citing several typical cases,it analyzes the current legal regulation status of traffic fraud in my country,summarizes the experience and wisdom in law enforcement and judicial practice,and analyzes the real dilemma faced by regulating traffic fraud in law enforcement and judicial levels.For example,in law enforcement practice,there are still problems such as single regulation method,unclear rights and responsibilities of law enforcement subjects,overlapping functions,and low supervision efficiency;rights and remedies,etc.Finally,on the basis of summarizing the deficiencies of existing regulations,a multi-subject co-governance mechanism for traffic fraud in the live e-commerce industry is constructed from the four levels of the state,society,platform and individual.Specifically,the state should improve the legislation on traffic fraud.Regulation,administrative regulation,and judicial regulation;the society should establish a third-party regulatory agency,establish a third-party credit evaluation mechanism,and improve the self-discipline mechanism of the live e-commerce industry;platforms should establish a pre-prevention mechanism,play a role in in-process supervision,and improve post-event remedial measures;Personally,merchants should improve their awareness of honest business operations,anchors with goods should improve their professional ethics,and consumers should establish a correct consumption concept and increase their awareness of rights protection.
