When it comes to the rights and interests of employees,the public’s understanding is more from the labor law,labor contract law,social insurance law and other laws specifically aimed at the adjustment of labor relations,and rarely realize that the Company law also includes the rights and interests of employees.The incorporation of corporate social responsibility law not only provides the justification and necessity explanation for the company to assume the responsibility of protecting the rights and interests of the employees,but also builds a solid bridge for the content of the rights and interests of the employees in the Company law and the provisions of the rights and interests of the employees in other department laws,strengthens the compatibility and coordination among the laws of various departments,and makes the connection between the laws closer.The traditional view equates the labor rights and interests enjoyed by the workers,such as rest,basic insurance,subsidies and education,with the rights and interests of the workers,which reflects the lack of thorough understanding of the rights and interests of the workers.As employees play an increasingly important role in the survival and development of the company and become indispensable assets of the company,their rights and interests show an expanding trend.In addition to labor rights and interests,by virtue of the human capital invested in the company and the social attributes of the company,employees enjoy the expressed rights and interests of the company’s affairs and the management rights and interests of the company’s operation.These non-labor rights and interests have been written into the current company law,and together with the labor rights and interests of employees constitute a complete rights and interests of employees.The embodiment of the company’s social responsibility in the scope of the employee group,especially the protection of labor rights and interests,the special laws have been very perfect,but other rights and interests protection provisions are still in the stage of setting up the framework and lack of pertinently,resulting in these rights and interests are difficult to be truly implemented in reality,and aggravate the violation of the labor rights and interests of employees.In addition,the current situation of external negative supervision and the company’s own weak sense of social responsibility are also important factors contributing to the current dilemma of protecting workers’ rights and interests.Therefore,to improve the protection system of workers’ rights and interests,in addition to the improvement and supplement at the legislative level,external supervision and the cultivation of corporate social responsibility consciousness are also important,because the effective combination of internal and external can truly realize the expectations and social values given by lawmakers in the system.
