Enterprise Data Security Criminal Compliance Study

With the popularity of data technology,the wide circulation of data and the proliferation of data values,many new issues and challenges are brought to traditional rights protection.Among the legal risks that enterprise data security may encounter,the criminal legal risk related to criminal offenses is undoubtedly the most serious.Therefore,how to effectively protect the enterprise’s data is a hot topic of current research.Based on the guidance of the concept of crime prevention,a total of five parts are divided into the following to elaborate on the criminal compliance of enterprise data security:First is the introduction of the article,which mainly elaborates the following three contents,one is to discuss the background of the topic chosen for this thesis in conjunction with the regulation and protection of data rights in China in the era of big data;second is the literature review study,which mainly discusses the criminal compliance of data crimes,especially the categorization of data security regulation after the introduction of the Data Security Law,absorbing and drawing on the institutional design of criminal regulation of existing enterprise data security,and finally summarizes the main contents as well as the research methods used.Chapter 1 is a discussion of the problems exposed in previous corporate data crime cases in the context of the dilemma of corporate data security regulation in the era of big data and the incidence of corporate data-related criminal crimes,so as to propose how to prevent corporate data security risks and the issue of corporate data security criminal compliance prevention from the perspective of enterprises;The second chapter is a basic overview of enterprise data security.The chapter first provides an overview of data,personal information and related concepts,and then specifically analyzes the existing legal security basis for enterprise data security,as well as discusses the three major risk situations that enterprise data security now faces: external,internal and accidental.Chapter 3 describes the need for criminal compliance for enterprise data security.From the overview of criminal compliance,the five major crimes of data crime,namely the crime of helping information network criminal activities,the crime of infringing citizens’ personal information,the crime of endangering computer information system,the crime of refusing to fulfill the obligations of information network security management,and the crime of endangering national security,are discussed in detail,and then the three aspects of enterprise data acquisition,data transaction,and data security management are Then,we conduct an empirical analysis on the criminal risks of enterprise data acquisition,data transaction and data security management,and finally propose the significance of data security criminal compliance;Chapter 4 is about the criminal compliance path of enterprise data security.In the first two chapters,the main crimes and criminal risks of data crimes have been discussed in detail,and then combined with the above analysis and the features of the disclosed data compliance type of rectification,we provide some reference ideas on the enterprise data independent compliance from the aspects of enterprise compliance management system and enterprise internal system construction.
