Research On The Procedure Of China Coast Guard Implementing Administrative Compulsory Measures

In March 2013,the " State Council Institutional Reform and Functional Transformation Program " was formally adopted at the first meeting of the Twelfth National People ’s Congress.After that,the National Oceanic Administration began to carry out maritime rights enforcement in the name of China Coast Guard.In July 2018,the Maritime Police Force was formally incorporated into the Armed Police Force to assume responsibility for maritime rights protection and law enforcement.Compared with the implementation of administrative coercive measures on land,the implementation of administrative coercive measures in the marine environment has its particularity.The application of the same procedural provisions as on land cannot fully meet the actual work needs of the China Coast Guard in implementing administrative enforcement measures in the marine environment.Therefore,it is necessary to study this issue.The further standardization of the procedures for the implementation of administrative compulsory measures by the China Coast Guard is of great significance for improving the overall environment of law enforcement by the China Coast Guard,establishing the authority of the China Coast Guard,improving the efficiency of administrative law enforcement by the China Coast Guard,and safeguarding the legitimate rights and interests of the China Coast Guard administrative counterparts.It has certain theoretical value and practical value to conduct in-depth research on the problems existing in the process of implementing administrative compulsory measures by China Coast Guard.The research adopts the methods of literature research,inductive analysis and case analysis.Through the investigation and research on the legislation and work practice of the administrative compulsory measures procedure of the China Coast Guard,the specific implementation of the administrative compulsory measures procedure in the field of maritime law enforcement is understood and understood in an all-round way,and further points out some problems and deficiencies in the current legal provisions of our country,and puts forward relevant countermeasures and suggestions on these problems.On the basis of the basic theoretical research on the procedure of implementing administrative compulsory measures by China Coast Guard,this paper finds out the problems existing in the procedure of implementing administrative compulsory measures by China Coast Guard,and puts forward targeted solutions to provide theoretical support for the improvement of the legal system of maritime administrative law enforcement procedure in China;under the new background of the integration of the Coast Guard into the Armed Police Force to carry out maritime rights protection and law enforcement in the name of the China Coast Guard,the theoretical research gap of the implementation of administrative compulsory measures by the China Coast Guard is filled.Through the analysis of the specific cases of the implementation of administrative compulsory measures by the China Coast Guard,this paper finds out the practical problems existing in the implementation of the administrative compulsory measures by the China Coast Guard and puts forward solutions,so as to provide some reference for the practical work of maritime law enforcement in the future.
