Research On Legal Issues Of Virtual Property Transaction On Internet

In the era of social progress and rapid technological development,the online economy plays an increasingly important role,while online virtual property also deserves the attention of society.1 January 2021,the Civil Code of the People’s Republic of China came into force,and Article 127 stipulates that where the law provides for the protection of data and online virtual property,it shall be in accordance with its provisions.Other relevant laws,such as the Law of the People’s Republic of China on Network Security,which makes relevant regulations on network operators,the Law of the People’s Republic of China on Data Security,which makes clear provisions on the concept of data,and the Decision of the Standing Committee of the National People’s Congress on Strengthening the Protection of Network Information,are designed to promote the green and protect the legitimate rights and interests of individuals,legal persons or other organizations.The above laws have also not stipulated the concept,legal nature,etc.of network virtual property.This article discusses network virtual property transactions through four parts.The first part discusses the conceptual characteristics of network virtual property and the distinction between it and related concepts.The second part delves into and analyses the shortcomings in network virtual property transactions,with a view to providing reference for improving the relevant protection system of network virtual property and ensuring the healthy and green development of the Internet industry.The third part discusses the excellent experience of foreign countries in the protection of online virtual property and puts forward the desirable points in China.The fourth sub-part addresses the difficulties faced by online virtual property transactions and proposes countermeasures to clarify the ownership of virtual property rights,unify the criteria for determining the validity of its transaction contracts,improve the procedures for assessing the value of online virtual property transactions and establish the jurisdictional basis for disputes over online virtual property transactions,drawing on advanced overseas experience and China’s judicial practice.Although network virtual property faces many difficulties in practice,we should still give support to it.Most scholars recognize the property attributes of online virtual property and believe that such transactions are private,and that regulating issues related to online virtual property can not only promote a deeper understanding of online virtual property and promote the development of the online market economy,but also better guide people to protect their legitimate rights and interests in the right way.
