Research On Dishonest Executees List System From The Perspective Of Blockchain Technology

With the rapid development of the socialist market economy,people’s transactions and interactions become increasingly frequent,and with it,more and more dishonest behaviors emerge,seriously endangering the honest and trustworthy market economic order.What’s more,acts of refusing to comply with court decisions and evading enforcement have emerged in an endless stream,seriously damaging the efficiency of civil enforcement work,and derogating from China’s judicial authority and legal dignity.To this end,the Supreme People’s Court officially promulgated the "Several Provisions on the Disclosure of Information on the List of Persons Subject to Enforced Breach of Faith" in July 2013,which aims to deter and punish those subject to enforced breach of faith by establishing a list system of persons subject to enforced breach of faith,urging them to fulfill their judgment obligations,and effectively solving civil enforcement problems.The implementation of this system has achieved great results,but many problems have also emerged in practical operation,making this system unable to fully achieve legislative objectives.In order to better carry out enforcement work,the court focuses on promoting the construction of smart courts,accelerating the integration of enforcement work and information technology,and striving to improve the list system of dishonest defendants through information construction.In recent years,with the widespread implementation of networking,intelligence,and informatization,scientific and technological innovation has become a new driving force to effectively solve implementation challenges.As an emerging technology,blockchain has great potential,with many functions such as data sharing,data storage,traceability,and digital identity.Applying blockchain technology to the execution field,grasping the opportunities of the era brought by informatization,establishing and improving a network execution inspection and control system,and strengthening data and information docking with other relevant departments can help strengthen the execution linkage mechanism and improve the efficiency and strength of execution work,To further improve the list system of those who have been executed for dishonesty and achieve a significant change in the implementation mode.This paper is divided into four parts.In the first part,by defining related concepts,the theoretical basis of the list system of untrustworthy executors from the perspective of blockchain is briefly described,and the connotation and characteristics of blockchain and the list system of untrustworthy executors are clarified;The second part,through the analysis of the relevant legislative norms and judicial practice data of the list system,combined with the actual operation dilemma of the current list system of untrustworthy executors,puts forward the necessity of perfecting the list system;The third part focuses on the feasibility of the combination of blockchain technology and list system,and the gains brought by the combination of list system and this technology;The fourth part,by analyzing the application prospect of blockchain technology in the field of disciplinary action against dishonesty,puts forward the concrete improvement and application path of blockchain technology in the list system of untrustworthy executors.
