Study On The Maritime Administrative Law Enforcement Power Of Chinese Maritime Police

To meet the realistic needs of the development of national maritime security strategy and the realization of maritime administration and law enforcement in line with international standards,and to achieve the strategic goal of a strong maritime nation at an early date.In addition to having a strong navy and a flexible diplomatic strategy,a professional maritime police agency is also essential.The transfer of the maritime police agencies and the promulgation of the Law of the People’s Republic of China on Maritime Police established the status of the maritime police agencies as the main body of maritime law enforcement.Chapter IV of the Marine Police Law even provides that marine police agencies are entitled to supervision and inspection,administrative coercion,administrative punishment and other administrative law enforcement powers in the fields of maritime security management,marine resources development and utilization,marine ecological and environmental protection,and marine fisheries management in accordance with the law.Provide a legal basis for the marine police agencies to exercise maritime administrative law enforcement powers.The decision to exercise maritime administrative and law enforcement powers by the transferred maritime police agencies has been implemented for many years,and many problems have begun to emerge in practice.In order to better implement the maritime administrative and law enforcement powers of the maritime police and help the country gain the initiative in maritime territories and rights and interests.It is of great theoretical and practical significance to study and explore the relevant contents of the maritime administrative law enforcement rights of the marine police.The research adopts a combination of literature search,case analysis,and induction and summarization to summarize the connotation and characteristics of maritime administrative law enforcement power on the basis of sorting out relevant theoretical studies,sort out the special identity attributes of maritime police agencies and the justification of their exercise of maritime administrative law enforcement power;systematically elucidate the current situation of maritime administrative law enforcement power of maritime police in terms of legal basis,categories of matters,and ways of realizing the power;find out the maritime administrative law enforcement power of maritime police agencies and the process of applying the power.In order to find out the problems in the maritime administrative law enforcement power of the maritime police and the mechanism of procedural provisions and power in the process of applying the power,and analyze the reasons for them,so as to explore the path of improving the maritime administrative law enforcement power of the maritime police in China.Based on the realistic needs of the maritime administrative law enforcement power of the marine police,the following suggestions are put forward from the perspective of theory,current situation,problems and causes: clarifying the boundaries of the maritime administrative law enforcement power of the marine police agencies,improving the maritime administrative law enforcement coordination mechanism;refining the procedural provisions of the application of the maritime administrative law enforcement power of the marine police;clarifying the jurisdiction of the maritime administrative law enforcement power of the marine police agencies and the division of cases;establishing and improving the supervision mechanism of the maritime administrative law enforcement power of the marine police and building a mechanism for the supervision of the maritime administrative law enforcement power of the marine police.The mechanism of supervision of the maritime administrative law enforcement authority and the construction of a strict fault-finding mechanism.In this way,China’s maritime administrative law enforcement activities are regulated and the effectiveness of law enforcement is improved.This will have a positive effect on better coping with maritime risks,fulfilling maritime rights maintenance and law enforcement tasks,and building a strong maritime nation.
