On The Boarding Inspection Of Maritime Police Law

Under the deployment of the strategy of building a maritime power,our country has given unprecedented attention to maritime rights.In recent years,the maritime disputes between China and neighboring countries have been frequent,and maritime accidents have occurred frequently.China’s maritime security is facing unprecedented challenges.As an important means for the coast guard to carry out the task of maritime security,landing and inspection are of great significance for maintaining the order on the sea and safeguarding maritime rights and interests.However,although the law of the Coast Guard stipulates that the coast guard can land and check the ships within the jurisdiction of our country,it does not state the specific implementation procedures.At present,there are few papers about the coast guard agency landing,check,most of the existing research is about the right of international law.This paper firstly adopts the method of literature review,comparative analysis and summary,and summarizes the concept,nature and characteristics of the "Coast Guard Law" boarding and inspection.Then,combined with the provisions on boarding and inspection in the Coast Guard Law and other laws,the specific application and implementation procedures of boarding and inspection are sorted out,as well as the inspection contents of the Coast guard after boarding the ship.On this basis,it concludes that there are some problems in the "Coast Guard Law",such as the vague division of power among law enforcement subjects,the specific procedures are not detailed enough,the procedural mechanism of inter-departmental coordination has not been established,the information disclosure procedures are missing,and the relief system is insufficient,and analyzes the reasons from subjective and objective aspects.Finally,through the study of the United States Coast Guard boarding procedures and the cooperation with other law enforcement forces in the process of law enforcement,find out the difference between the United States Coast Guard and Chinese coast guard agencies boarding,inspection,and put forward the corresponding countermeasures and suggestions.In addition to the introduction and conclusion,the article consists of five parts.The first part introduces the general principles of the boarding and inspection of the Coast guard;the second part summarizes the application of the boarding and inspection,the implementation procedures and the contents of the ship inspection;the third part summarizes the existing problems and causes of the boarding and inspection of the Coast Guard Law;the fourth part analyzes the enlightenment brought by the boarding procedures of the United States Coast Guard.The fifth part is based on the analysis of the problems and reasons existing in the boarding and inspection,combined with the enlightenment of the United States Coast Guard,put forward the corresponding countermeasures and suggestions.Specifically,it includes the scientific division of the power boundary between the coast guard and other subjects,the elaboration of the relevant provisions of the specific procedures for boarding and inspection,the establishment of cross-departmental law enforcement assistance procedures for boarding and inspection,the improvement of the information disclosure procedures for boarding and inspection,and the improvement of the relief system for boarding and inspection.
