In the age of big data,the value of personal information has become more and more prominent.The ubiquitous nature of the Internet has made the protection of children’s personal information a huge challenge,and the threat to children’s personal information caused by offline information handling practices should not be underestimated.Compared with adults,children lack self-protection awareness and are more vulnerable to unlawful infringement,and need special protection under the law.How to effectively respond to the new changes and challenges facing the protection of children’s personal information is a real problem that needs to be solved.The Personal Information Protection Law,as the first systematic and comprehensive law in China,not only provides special rules for the handling of children’s personal information,but also highlights the special role of public interest litigation by prosecutors in the protection of children’s personal information,reflecting the positive attitude of legislation to protect children’s personal information.However,it is undeniable that the existing laws and regulations in China are still not well connected to the security of children’s personal information in real life,the guardian’s informed consent system needs to be refined,and some specific rights(such as the right to delete)still need to be improved in the exercise of rights,etc.There are many problems to be solved in the implementation of personal information protection as a new area of public interest litigation.In this regard,on the one hand,it is necessary to strengthen the legislative connection,clarify the legal grounds for exemption of "guardian’s consent",improve the guardian’s informed consent system,and relax the conditions for children to exercise the right of deletion,on the other hand,it is necessary to increase the protection of children’s personal information in public interest litigation.At the same time,companies should also establish a technical governance mechanism covering the entire process of handling children’s personal information.Only when all parties form a joint effort can we better protect the growth of children. |
