Research On The Protection Of Spouse Property Rights And Interests In Natural Person Bankruptcy

With the rapid development of industries such as internet finance and consumer credit,th e debt ratio of residents is gradually increasing,and it is urgent to establish a natural person sy stem about bankruptcy.However,how to fully protect the property rights and interests of spou ses in the process of establishing and improving the natural person bankruptcy system is not o nly related to the stability of the family,but also to the stability of society.In view of this,this article focuses on the topic of "Protecting the Property Rights and Interests of Spouses in Natu ral Person Bankruptcy".Through various methods such as literature analysis,case analysis,co mparative analysis,etc.,it conducts a systematic and in-depth study on the legal issues of prot ecting the property rights and interests of spouses in Natural Person Bankruptcy,striving to pr opose a system design plan with theoretical significance and practical value.Specifically,in addition to the introduction,the entire paper is divided into four parts.The introduction mainly introduces the research background,significance,current research status at home and abroad,research methods,and innovations of this topic.The first part is about the basic theory of safeguarding the property rights and interests of spouses in natural person ban kruptcy.Based on the concentrated exploration of the basic concepts of natural person bankrup tcy and spouse property rights,this paper proposes the basic principles that should be followed to protect spouse property rights and interests in natural person bankruptcy,and further analyz es the necessity of protecting spouse property rights and interests in natural person bankruptcy.The second part is about the current status of property rights protection regulations for spouse s in natural person bankruptcy in China.Through a systematic review of the legislative and jud icial status of safeguarding the property rights and interests of spouses in natural person bankr uptcy,it was found that there are still issues in the protection practice,such as the difficulty in defining free property in natural person bankruptcy,the difficulty in safeguarding spouse resid ency rights after bankruptcy execution,the difficulty in achieving marital division of spouse pr operty,and disputes over the scope of joint debt between spouses.The third part is a comparati ve study on the protection of spouses’ property rights and interests in the bankruptcy of natural persons outside the region.By comparing and analyzing the practice of protecting the propert y rights and interests of spouses in the bankruptcy of natural persons in typical countries of the continental legal system and the Anglo American legal system,summarizing their advanced e xperience,this paper proposes inspiration for the construction of the property rights and intere sts protection system of spouses in the bankruptcy of natural person in China.The fourth part i s about suggestions for improving the protection of spouse property rights and interests in the bankruptcy of natural persons in China.Based on the comprehensive research mentioned abov e,suggestions for improving the protection of spouse’s property rights in natural person bankru ptcy are proposed from the aspects of strengthening the protection of spouse’s property rights u nder the free property system,ensuring the spouse’s right to reside after the execution of real e state bankruptcy,establishing a legal situation for marital separation to achieve marital divisio n,and clarifying the joint debt borne by the spouse within marriage,in order to provide suppor t for their legal practice.
