The non-governmental entities discussed in this article refer primarily to private companies.In recent years,non-governmental entities have been active in outer space,and the launch of a large number of small satellites has brought many challenges to the use of outer space,such as the impact on national security,and how to use outer space fairly and effectively under the premise of peace,appear particularly prominent.This paper first summarizes the development of the subject of outer space launch activities.Describes the evolution process from a single subject to multiple subjects,summarizes the early government launch practice and the launch activities of non-government entities today;analyzes the characteristics of non-government entity launch activities-the most active launch subject today,mainly engaged in commercial launches,Constrained by international law and domestic law at the same time,it mainly focuses on the launch of small satellites and plays a role in the form of satellite constellations;and introduces the laws regulating non-governmental entities from the perspective of international law and domestic law.The challenges to outer space law posed by small satellite launches by non-governmental entities are then discussed.Although the laws regulating outer space activities have made provisions on national security,the peaceful use of outer space,and the use of outer space,the rapid development of the times has far exceeded legislative expectations.The outer space law has been difficult to amend since it was enacted.The disparity between the two countries leads to different discourse rights,and the existing rules cannot deal with the challenges to the outer space law brought about by the small satellite launch activities of non-political and legal entities.The first is the launch of small satellites and national security,which mainly analyzes the impact on national security from two aspects: network communication and small satellite remote sensing technology;the second is the challenge of small satellite launches to the principle of peaceful use of outer space.Small satellites are currently widely used Applied in the military field,it has constituted the country’s national defense force.The conflict between Russia and Ukraine has fully demonstrated the powerful capabilities of satellite constellations.The current practice of space powers shows that they have mature anti-satellite capabilities.At the same time,the outer space law system does not prohibit the Earth orbit The weaponization and militarization of space,which brings the possibility of armed conflicts in outer space;the third is the launch of small satellites and the use of outer space.The launched small satellites have seized a large number of limited orbital resources.The fair and efficient use of orbital resources creates conflicts,while launching a large number of small satellites makes outer space crowded and space debris increases.These issues,which were not prominent in the early uses of outer space,must be considered with the increased activity of non-governmental entities in recent years.Finally,solutions to the above problems are proposed.In the twenty-first century,it is not easy to reach consensus on new treaties,especially those that are mandatory.The world pattern is changing,and it is currently impractical to solve the problem of outer space by formulating new outer space laws.Although the United Nations and other international organizations have formulated many soft law rules for outer space,they only have guiding opinions,which is not binding on international law,cannot effectively address these challenges.Therefore,the countermeasures proposed in this paper give more consideration to whether the existing international legal system can be used to solve problems,such as the application of international humanitarian law in outer space and the reference and application of principles of international environmental law.
