Since 2020,the global economy has been hit hard by the novel coronavirus,and some industries,such as tourism,catering,clothing and most manufacturing industries,have also experienced a cold winter.However,the game industry has not been affected.On the contrary,most people are isolated at home due to the epidemic,and it has become a pastime activity,leading to further prosperity of the game industry.But everything has two sides,illegal crimes exist in all walks of life,the game industry is no exception,because cyber crimes are not affected by the epidemic,high stealth,in recent years,on the contrary,there is a trend of high incidence,especially the crime involving online games,it is difficult to crack down on this kind of crime,the main prevention and control measures are to rely on the game developers unilateral security technology detection.There is still a long way to go to stop the plug-in behavior,so it brings a lot of troubles to the sustainable and stable development of the game industry.In judicial practice,the determination of the charges of making and selling plug-ins is different in different periods,and even the choice and application of the charges in the same period are different.The main charges involved are the crime of illegal business,the crime of copyright infringement and the crime of selling infringing copies,and the crime of providing intrusion and illegal control of computer information system procedures and tools.In terms of structure,this paper first introduces the overview of online game plugins involved in crime,which includes the definition of network plugins,the charges involved,the qualitative basis and so on.In the first chapter,try to elaborate the theoretical aspects of online game plugins involved in crime.Next,combined with the theoretical basis of the first chapter,it introduces the main problems of judicial personnel’s fuzzy cognition of game plug-in and the application of specific charges in online game plug-in cases in judicial practice,and summarizes the defects existing in the application of each charge.At the same time,the reasons for not applying illegal business crime and traditional computer behavior crime are explained.In addition,this paper points out that the behavior of cheating in games by using plugins without any illegal profits should not be evaluated as a criminal offense at this stage.
