Research On The Legislative Regulation Of Uncivilized Behavio

In modern society,the level of urban civilization has become the main measure of ecological quality,living environment and basic social order.Facing the growing demand for civilized urban management,how to effectively regulate all kinds of uncivilized behavior through law has always been an important topic and research content of local legislation.Based on the theory of civilized rule of law,this paper introduces chart analysis and logical demonstration to prove the inevitable trend of legislative regulation of uncivilized behavior from the theoretical aspects of moral legalization and socialist core values.At the same time,by studying the current situation of uncivilized behavior governance,evaluating legislative risks and making legislative assumptions,this paper constructs an uncivilized behavior regulation law model including legislative model,adjustment scope,law enforcement means,law-abiding measures and so on.The results show that: firstly,there is an inevitable connection between civilization and morality.Restricting citizens’ words and deeds in the form of law meets the reasonable requirements of moral legalization;Secondly,due to the limitations of administrative law and civilization promotion regulations,it is necessary to make special legislation to regulate uncivilized behavior.At the same time,the comprehensive application of promoting legislation mode and management legislation mode can better meet the practical needs of uncivilized behavior regulation than a single legislation mode;Thirdly,Fuller’s moral stratification theory and Japan’s light crime law have strong reference and guiding significance for the governance of uncivilized behavior in China.Some of them can be integrated into the implementation and implementation theory of China’s uncivilized behavior regulation law after being processed according to national conditions;In addition,the personal civilized credit investigation system is a necessary means for the operation of the uncivilized behavior regulation law,and the hardware facilities of each city are the basic premise for the implementation of the regulation law.Generally speaking,the legislative regulation of uncivilized behavior needs many aspects and ways,considering many problems.This study not only provides a new path of specialized legislation for the governance of uncivilized behavior in China,but also provides theoretical support and measures for the legal regulation of uncivilized behavior.
