Network judicial auction margin is the people’s court to ensure the smooth progress of the judicial auction activity to be willing to participate in the auction bidders according to the certain proportion of started a necessary charge,charge of it can not only show that bidder sincere willingness to participate in judicial auction and that bidder has the certain economic power can take part in the auction.Although deposit payment is a very small part in China’s online judicial auction,it still plays a very important role,and the author found that it still needs to be improved during the investigation.This paper intends to use literature research method,case analysis method,comparative analysis method and other methods to study and sort out the problems existing in the network judicial auction security system,and try to find appropriate solutions to the shortcomings of the current network judicial auction security system,in order to provide some reference for solving the problem.In addition to the abstract and conclusion,the remaining main content of this paper is as follows:The first part is the predicament of the security deposit of network judicial auction.This paper focuses on the problems and controversies in the actual operation of the network judicial auction deposit system,and combs the current situation of theoretical research and practical exploration of the network judicial auction in China from two perspectives,namely,the dilemma of the deposit payment and the difference compensation of the network judicial auction.At present,domestic exploration has been carried out on the amount of security in online judicial auction and the disposal methods after the default auction,but the researches are sporadic and not systematic and many regulations are still relatively rough,resulting in difficulties in how to deal with actual cases after they occur.Therefore,the research in this area needs to be strengthened.The second part is the analysis of the reasons why the online judicial auction deposit is facing difficulties.This part mainly starts from the perspective of the auction platform,the perspective of the person who fails to bid and the reasons of the system itself,to find the deep reasons for the difficulties faced by the security of online judicial auction,and to lay the foundation for the solution proposed in the following part.The third part is the reference and investigation of the system outside the region.Although the countries outside the region did not adopt the way of online judicial auction to turn the seized property into cash like China,some countries adopting the way of judicial auction also have good measures worthy of our reference.This part is mainly based on the analysis of the reasons for the difficulties faced by the network judicial auction deposit in the previous part,referring to the analysis of some advanced practices in this area outside the region,looking for useful experience to improve the network judicial auction deposit system in China.The fourth part of the network judicial auction security system to improve the suggestions.Based on the analysis of the problems existing in the network judicial auction deposit system,this part fully draws on the advanced practices of Japan,Germany and other developed countries under the rule of law,and puts forward corresponding improvement suggestions in combination with China’s national conditions,so as to promote the healthy development of China’s network judicial auction deposit system.
