Research On Procuratorial Supervision Of Compulsory Isolated Detoxification

Since the establishment of the compulsory isolated detoxification system,it has become a sharp weapon for detoxification work in China,because of its professionalism and high efficiency.However,on the one hand,the system lacks effective supervision,on the other hand,there are many problems such as non-standard law enforcement,hidden dangers in management,and inadequate protection of human rights.Based on the function of legal supervision,the procuratorial organs have responded positively,and carried out the pilot work of procuratorial supervision of compulsory isolated detoxification,which has borne some fruit,but also face many risks and challenges.On the basis of thoroughly grasping the historical evolution,current exploration,existing basis and problems,and these causes,this thesis suggests targeted measures and suggestions,so as to provide a reference for the pilot work of procuratorial supervision of compulsory isolated detoxification.Apart from the conclusion,the article can be divided into the following five parts: The first part is the introduction.This part introduces the research background,purpose and significance of the article.It conducts the literature review,analyzes the relevant viewpoints,and clarifies the research methods and innovation points of the article.The second part is the summary of compulsory isolated detoxification.This part provides a qualitative analysis,a longitudinal description and a background introduction of the procuratorial supervision of compulsory isolated detoxification from its concept,evolution and basis.It initially establishes the cognitive system of the procuratorial supervision of compulsory isolated detoxification.The third part is the legitimacy of the procuratorial supervision of compulsory isolated detoxification.This part proves that the procuratorial supervision is legitimate from the perspectives of theoretical logic and realistic reasons,and provides legal support for the procuratorial supervision of compulsory isolated detoxification.The fourth part analyzes the effectiveness of the procuratorial supervision of compulsory isolated detoxification.This part summarizes and dialectically analyzes the pilot exploration of procuratorial supervision of compulsory isolated detoxification.On the one hand,it affirms the positive role of the procuratorial supervision of compulsory isolated detoxification in ensuring the implementation of law,maintaining the order of detoxification and protecting the personal rights and interests;on the other hand,it points out that the supervision basis is insufficient,supervision matters are not clear,supervision ability is not strong,and other problems.The fifth part is the countermeasures of the problems mentioned above.This part is based on practice,looks forward to the future,and puts forward targeted solutions.First of all,the thesis puts forward to strengthen the supervision basis,and construct the relevant legislative path in three steps,so as to help the procuratorial supervision of compulsory isolated detoxification to get into the legal track as soon as possible.Secondly,it puts forward to make clear the supervision principles,scope and priorities and other related matters to help establishing the top-level system of procuratorial supervision for compulsory isolated detoxification.Finally,feasible measures are proposed from the perspectives of strengthening the team building,optimizing supervision modes and establishing the cooperation mechanism to improve the procuratorial supervision ability of compulsory isolated detoxification.
