Research On The Legal Regulation Of Digital RMB Issuance And Circulation

Blockchain technology promotes the digital transformation of currency.Digital currency is an important strategic choice to adapt to the digital transformation of currency.At present,many countries are developing digital currency research and development,and test promotion in a large scope,its issuance modes of each different,our country started digital yuan research and development officially in 2014,set up the Institute of Digital Currency of the People’s Bank of China in 2016.After eight years of research and testing,digital RMB has built a complete payment platform,and in 2019,pilot tests of digital RMB were carried out in Shenzhen,Suzhou,Xiong an,Shanghai and other cities and gradually promoted.Since February 2023,the digital RMB has been piloted and tested in 23 cities in 17 provinces across the country.The application scenarios of the digital RMB not only involve the clothing,food,housing and transportation,medical consultation and elderly care services in the field of social life,but also involve the tax payment in the field of public service and administration,agricultural fund guarantee in the field of rural revitalization,and financial services for "agriculture,rural areas and farmers".With the maturity and promotion of digital RMB,legal problems such as personal information leakage,money laundering,counterfeit currency and supervision have become increasingly serious,causing widespread concern in the society.In this thesis,insufficient legal basis,personal information leakage,money laundering of counterfeit currency and regulatory issues in the two links of digital RMB issuance and circulation are studied,with specific contents as follows.The first part focuses on the introduction of the digital RMB issuance and circulation practice.This thesis specifically discusses the whole process of the birth of the digital RMB from scratch and the pilot process in the whole country,summarizes the underlying technical principles and application scenarios of the digital RMB issuance,and introduces the application situations in the application scenarios.The second part introduces the legal attribute of digital RMB and the necessity of regulation.By comparing the digital RMB with other currencies,it is clear that the digital RMB is the digital form of RMB and has the same legal compensation as the ordinary form of RMB.On this basis,it further points out the necessity of legal regulation of digital RMB,including breaking through the monopoly of western SWIFT system on international trade settlement,making up for the deficiencies of traditional currency payment,improving the economic regulation ability of the central bank,preventing financial decoal and improving the level of risk prevention and control,so as to make it more in line with the payment needs of the public in the circulation process.The third part mainly introduces the problems existing in the issuing process of digital RMB and how to regulate the problems legally.The main problems include inadequate legal basis for issuance,legal compensation and personal information disclosure,and put forward specific solutions to the existing problems.The fourth part mainly introduces the problems existing in the circulation process of digital RMB and how to regulate the problems legally.The main problems include money laundering crime,counterfeit money crime and so on,and put forward suggestions to solve the above problems,reduce the occurrence of currency crime.
