| As a practical theme with Chinese characteristics and an important element of administrative law enforcement reform,comprehensive administrative law enforcement reform is a process of transforming institutional advantages into governance effectiveness,reflecting the organic interface between central coordination and local graded promotion,top-level policy calibre and grassroots policy operational innovation.As the frontline of the social management system,township governments have a profound impact on the daily lives of the general public and play a crucial role in governance practices.Since 2019,Hebei Province has promoted comprehensive administrative law enforcement reform in townships and formulated the Hebei Provincial Comprehensive Administrative Law Enforcement in Townships and Streets in accordance with the Law of the People’s Republic of China on Administrative Punishment and the Regulations on Local Legislation of Hebei Province and other laws and regulations.The law enforcement reform has achieved certain results,with the township government conducting efficient governance at source and the atmosphere of law-based administration becoming stronger,but some problems have been exposed in the law enforcement process,such as insufficient levels of law enforcement,which directly lead to problems with the actual needs of grassroots governance.Then,how to scientifically divide law enforcement powers and how to co-ordinate and allocate lawenforcement resources to ensure that township governments can effectively undertake law enforcement powers has become an urgent issue to be resolved.Based on a review and analysis of domestic and foreign literature,this article adopts the case study method,taking the administrative law enforcement brigade of N township in S city as the research object,applying theories such as the rule of law government theory,street bureaucracy theory and the theory of consistent authority and responsibility,combined with the comprehensive law enforcement practice of N township,four short and precise cases with typical characteristics are selected to analyse their law enforcement activities,and it is found that the matters delegated by the provincial level are mostly the frequent and easy to occur violations of law in the township.The essence of the bottleneck in law enforcement is the imbalance in the supply of law enforcement power due to the inconsistency of powers and responsibilities.Based on this,this paper proposes policy recommendations on the supply of law enforcement powers,the construction of law enforcement forces and immunity from official liability,with a view to solving the real-life problems and improving and strengthening the level of comprehensive administrative law enforcement capabilities in townships. |
