Research On The Connection Mechanism Between Fishery Administrative Law Enforcement And Criminal Justice

In recent years,the cohesion of the administrative law enforcement and criminal justice issues increasingly brought to the attention of the countries,the fourth plenary session of the party’s eighteen is put forward to improve the cohesive mechanism of administrative law enforcement and criminal justice,through perfecting the suspected criminal cases transferred to standards and transfer procedures,set up information sharing platform,the administrative law enforcement organs and public security organs and procuratorial organs jointly establish case reporting system,To realize smooth transition between the line of the law enforcement and criminal justice,there is also in the field of fishery administrative law enforcement and criminal justice cohesion,improper handling of fishery administrative law enforcement and criminal justice cohesion,can lead to wade fishing class crime cannot get effective sanctions,even will seriously damage the fishery resources in China,irreversible effects on the ecological resources.In order to punish fishery crimes,the connection between fishery administrative law enforcement and criminal justice is particularly important.Therefore,based on the existing theoretical research basis of the linkage mechanism between administrative law enforcement and criminal justice,this paper defines the concept of the linkage mechanism between fishery administrative law enforcement and criminal justice,and studies the linkage mechanism between fishery administrative law enforcement and criminal justice in combination with the theory of administrative crime and the principle of priority of criminal law.Found case is transferred for standard is not clear,the difficulty of fishery administrative law enforcement organs,the administrative evidence conversion mechanism is imperfect,an analysis of the causes for the above problems and put forward the corresponding solution countermeasures,for Chinese fishery administrative law enforcement and criminal justice provides rich theoretical basis of cohesive devices,make the reduced cohesion carried out in the field of fishery.
