Research On Localization Of The Right Of Authorship System

As the core of the author’s right,the right of authorship is the right to mark the creative relationship between the author and the work,and can publicize the creative facts between the author and the work to the public.The relationship between the author and the work is often compared to the father-son relationship,and the right of authorship is the most intuitive sign of this relationship.Under the impact of globalization,the authorship system in China has been controversial in the practical and theoretical circles.This controversy comes from the legal connotation that does not have national expectation.Therefore,the authorship system in China urgently needs a filter of localization,and it is necessary to try to localized the authorship system in China.First of all,through the combing of practical cases and academic views,the problems of authorship system in "forged signature","authorship transfer" and "authorship attribution" are proposed,and the necessity of localization of authorship system is explained.Then follow the analysis of problems,along the country of authorship system establishment and development,through our country and lateral comparison,summarizes the system of authorship established "forced" and "passive",points out that the root cause of the problem of authorship system is mechanical legal transplantation,thus leads to legal localization.Finally,starting with the idea of localization of authorship system,clarify the connotation and extension of localization,clarify the localization path of authorship system in China,find the local resources,and find the soil for the localization of authorship system.Start from the function of authorship system,and interpret the connotation of authorship with the basic logic of local culture.In response to the problems existing in the right of authorship system,it is pointed out that "the forged signature violates the right of authorship","the right of authorship is nontransferable" and "the subject of the right of authorship must be attributed to the one who carried out the creative process".
