Research On The Trial In Criminal Absentia System From The Perspective Of Fugitive Recovery

Our country has been persistently fighting against corruption,and this struggle is not only reflected in politics,but also in firmly promoting the Party’s clean government.However,we also clearly realize that to solve these stubborn diseases,courage and determination are not enough,and there must also be a supporting and gradually improved legal system.Among them,the system of trial in absentia for fugitives is a sharp edge in the fight against corruption.General Secretary Xi Jinping also emphasized: "Never let overseas become a haven for corrupt elements." This has opened up a new battleground for anti-corruption,opened a new chapter in international anti-corruption cooperation,and demonstrated the firm determination to never let corrupt elements go unpunished.In 2018,my country legally established a criminal trial in absentia system,which includes provisions specifically for fugitive corrupt elements,convicting anti-corruption elements who abscond from abroad and recovering stolen money and stolen goods through trials.The new system has imperfect laws and little practical experience,so there are still many shortcomings in the operation of the system,and it is not enough to effectively achieve the anti-corruption purpose of establishing the system.There is still should to improve.Based on the current legislative status of the trial system in absentia in my country,combined with foreign experience,this paper proposes a perfect path for the trial system in absentia in our country from the perspective of chasing fugitives and recovering stolen goods,and strives to fight against corruption at both the domestic and international levels.It can effectively crack down on corrupt elements,effectively recover the property involved in cases that have been transferred overseas,and at the same time achieve the two goals of chasing fugitives and recovering stolen goods.However,while realizing the purpose of chasing fugitives and recovering stolen goods,the defects of the trial in absentia system cannot be forgotten.It is necessary to improve the system to protect the rights of criminal suspects and defendants,improve the service procedures and relief paths,and improve the mechanism of the trial in absentia system.In addition to paying attention to the rights of people,we must not forget the concern about things.My country’s system of tracing fugitives and recovering stolen goods does not have comprehensive provisions on property disposal.It is necessary to improve relevant legislation so as to make the difference between the illegal income procedure and the trial in absentia procedure.Connection is smoother.
