Biomedical technology is currently the fastest growing and most challenging technology in the field of biological sciences,and among the new biotechnologies that are closely related to the right to life and health of human beings,gene editing technology has become the focus of attention of all sectors of society in recent years.It is true that the proper use of new genetic medical technologies will undoubtedly bring great benefits to society,and that the development of gene editing technologies provides new means of diagnosing and treating diseases and improving human health.The rapid development of these technologies also suffers from a regulatory regime that lags behind the development of the technologies,and their improper application may even have irreversible results.Rash clinical research and inappropriate applications carry great risks and raise issues of biosafety,public safety and social ethics.How to mitigate the negative effects that accompany the development of genetic medical technologies and ensure that they develop in a direction that is beneficial to humanity is an issue that social science must address.This article,in the face of the rapid development of the technology,analyses the characteristics of the emerging genetic medical technology and the challenges in the construction of the current regulatory system,clarifies the rights of the subjects of legal relations under the emerging genetic technology,especially the exercise of autonomy,introduces the concept of paternalistic regulation on the basis of the analysis of rights,and analyses the basis of the legitimacy of regulation.On this basis,the existing regulatory tools are reviewed,the implications of the existing ethical principles for regulation are explored,the criteria for the design of regulatory systems are clarified,and the theoretical basis for the regulation of genetic health technologies is constructed.
