A Study On Legal Issues Of Slot Charter

In recent years,under the background of increasingly fierce international shipping competition and large-scale ships,in order to reduce operating costs and realize economy of scale,slot charter,which is both flexible and convenient,is increasingly favored by liner operators.However,with the development of the slot charter,there are some problems in judicial practice,such as unclear understanding of the concept of the slot charter,disputes over the nature of the slot charter,unclear legal application of the slot charter,vague identification of the rights and responsibilities of the subjects under slot charter,which objectively hinder the development of the slot charter.This thesis clarifies the legal problems arising from the slot charter,in order to provide theoretical support for the practice of slot chartering.The thesis is divided into three parts: introduction,body and conclusion.The body is divided into four chapters:The first chapter summarizes the slot charter,clarifies the concept,types and subjects under slot charters,and lays a theoretical foundation for the demonstration of subsequent chapters.This chapter is divided into three sections.The first section summarizes the expression of the concept of slot charter in domestic and foreign academic circles,and gives the definition of slot charter.The second section discusses the types and characteristics of slot charters.The third section discusses the subject under slot charter.The second chapter analyzes the nature of slot charter and studies the legal application of the slot charter.This chapter is divided into two sections.The first section compares the similarities and differences between the slot charter and the liner transportation contract,voyage charter party and time charter party,and determines the nature of the slot charter.The second section discusses the application of law from the perspective of adjusting the norms of arbitrary law and mandatory law of the slot charter,combined with the nature of the slot charter.The third chapter analyzes the rights,obligations and responsibilities of the shipowner under the slot charter.This chapter is divided into three sections.The first section discusses the rights of the space lessor,including the right to collect rents and the right to retain the goods and containers.The obligation of the shipowner includes the obligation of the shipowner to provide seaworthy vessels and not to deviate.The third section discusses the liability,period of liability and limitation of liability when the shipowner violates his obligations.The fourth chapter analyzes the rights,obligations and responsibilities of the slot charterer under the slot charter.This chapter is divided into three sections.The first section expounds the rights of the slot charterer,including the right to use slots,sublet slots and the right to change and terminate the charter party.The second section discusses the obligations of the slot charterer,including the obligation of guaranteeing and indemnifying and the obligation of compensation in case of ship loss.The third section discusses the liability,imputation principle and limitation of liability of the slot charterer.
