Study On The Conflict And Harmonization Of Laws Concerning Arctic Ecological Security

The Arctic ecological security problem is becoming more and more serious,and it is urgent for the laws to escort the ecological governance.However,in contrast to the current Arctic ecological security legal documents,due to the different formulation subjects,lack of systematic and the collision of interests of different countries,the conflicts between relevant legal documents will lead to serious consequences,and these conflicts must be solved through harmonization.Therefore,this thesis analyzes the manifestations and causes of conflicts of laws by combing the sources of laws of Arctic ecological security.This thesis discusses the harmonization path of conflicts of laws,and puts forward ideas for China’s participation under the harmonization of conflicts of laws of Arctic ecological security.The thesis is mainly divided into three parts: introduction,body and conclusion.The main body is divided into four chapters:The first chapter summarizes the legal system of Arctic ecological security.The first section is the definition of the connotation of ecological security,mainly including the proposal of the issue of Arctic ecological security,the concept of Arctic ecological security and the characteristics of Arctic ecological security;The second section is the necessity of legal governance of Arctic ecological security,which mainly introduces the impact of Arctic ecological security issues and the logical relationship between Arctic ecological issues and legal governance;The third section is the sources of laws of Arctic ecological security,which is mainly introduced from three aspects: the domestic legal documents of eight Arctic countries,near Arctic countries and the international legal documents of Arctic ecological security.The second chapter analyzes the conflicts of laws of Arctic ecological security.The first section is the manifestation of the conflicts of laws of Arctic ecological security,which mainly introduces the conflicts between international treaties,national laws and international treaties;The second section is the causes of the conflicts of laws of Arctic ecological security,which is mainly analyzed from three aspects: the lack of systematic of relevant laws,the limitations of soft law regulation and the fact that the legal setting is based on the interests of different countries;The third section is the consequences of the conflicts of laws of Arctic ecological security,which is mainly analyzed from two aspects: affecting the realization effect of legal function and intensifying the interest contradiction between countries.The third chapter discusses the harmonization of the conflicts of laws of Arctic ecological security.The first section is the feasibility analysis of traditional treaty conflict resolution;The second section is the reference model for the harmonization of conflicts of laws of Arctic ecological security,mainly introducing the "Antarctic Treaty" model,"Convention on the law of the sea" model,"Arctic Council governance model" and other models;The third section is to establish a legal harmonization system of Arctic ecological security with the Framework Convention as the core,which is mainly analyzed from three aspects: leading institutions,harmonization methods and harmonization principles.The fourth chapter explores China’s participation under the harmonization of the conflicts of laws of Arctic ecological security.The first section analyzes the legitimacy of China’s participation in international governance of the Arctic;The second section is the guiding concept of China’s participation in the harmonization of conflicts of laws of Arctic ecological security,mainly from two aspects: the concept of Arctic ecological community of common destiny and the concept of global Arctic governance;The third section is the path of China’s participation in the harmonization of conflicts of laws of Arctic ecological security,which is mainly analyzed from three aspects: promoting the supply of Arctic governance system,strengthening cooperation with the international community and standardizing the participation of domestic subjects in Arctic affairs,so as to contribute to the harmonization of conflicts of laws of Arctic ecological security.
