With the rapid and diversified development of Internet technology,various new problems have emerged,among which the legal problems caused by the crime of online rumors are becoming more and more serious.Online rumors spread fast,have a wide range of influence,and are highly concealed,not only endangering personal life,social order,and even national security.However,the current criminal law system in my country has relatively scattered legal norms on online rumor-based crimes,and cannot effectively combat crimes.In-depth study of online rumor crimes,to find out the current problems of my country’s criminal law regulating online rumor crimes,and to find coping strategies for the problems,in order to better realize the criminal law governance of online rumor crimes,protect citizens’ right to freedom of speech,and achieve effective The purpose of preventing online rumor crimes and maintaining normal order in cyberspace and real space.This paper is divided into four chapters,starting from the general theory of online rumors and the current situation of criminal law regulation of online rumors,analyzing the harm of online rumors in detail,and then combining the current situation of criminal law regulation of online rumors in my country to analyze the current problems and dilemmas in regulating online rumor crimes.,and make suggestions on how to solve existing problems.The main contents are comprehensively discussed as follows: The first chapter makes an in-depth analysis of the criminal law regulation of network rumors in theory,and analyzes the rationality of the criminal law regulation of network rumors;The relevant provisions of laws and regulations on punishing online rumors,summarizes the crime of punishing online rumors in China;the third chapter analyzes the problems and causes of online rumors in China from the current situation of China’s current criminal law for online rumors,including the crime of picking quarrels and provoking trouble The regulation of online rumors is unreasonable,the defamation crime has flaws in the regulation of online rumors,the legal punishment for some crimes is low,the lack of exclusive crimes,the single type of punishment,the incomplete regulation of the subjective foul of the crime,and the lack of legal regulations for online public relations companies and online platforms.The fourth chapter puts forward suggestions on improving the criminal law regulation of online rumors.According to the analysis in the third chapter of this article,it proposes to rationally cancel the application of the crime of picking quarrels and provoking trouble,accurately apply the crime of defamation,appropriately increase the legal penalty,enrich the crime of online rumors,and increase the fine.and eligibility punishment,improve the provision of subjective foul intentions,and increase the legal regulation of online public relations companies and online platforms.Online rumors are a complex phenomenon.In the process of controlling online rumors,it is necessary to correctly grasp the strength of the attack and the applicable means,and to control them must strictly grasp the spirit of the law,and reduce the harmfulness of online rumors through a series of governance measures.The lowest,making the information environment of the Internet more real.While ensuring the legitimate exercise of rights by citizens,we should appropriately adjust the content of criminal charges in our country’s criminal law,seek truth from facts,and enhance the operability of reality,so as to achieve statutory crime and punishment,and there are laws to abide by.On the basis of fully understanding the necessity of the criminal law to regulate the crime of online rumors,we should further improve the regulation of the crime of online rumors by the criminal law of our country.
