A Study On The Disclosure Of Government Internal Documents In Process Information

Government information disclosure is a basic means to promote administrative transparency.In the practice of government information disclosure in China,there have been a lot of discussion on process government information,and the disclosure of internal government documents is a very easy to ignore.People are increasingly dissatisfied with the traditional government information disclosure model,and gradually expand the breadth and depth of government information disclosure,which is also the proper meaning of promoting the openness and transparency of government affairs.The purpose of this thesis is to clarify the basic connotation and elements of government internal documents in process information,so as to provide a theoretical basis for the effective disclosure of internal documents in practice.Based on the discussion of the theoretical and practical aspects of the disclosure of government internal documents in process information,and the analysis of existing legal provisions,the problems encountered in the practice of government internal document disclosure in process information are extracted,and specific solutions are obtained accordingly.Government internal documents in procedural information are repeatedly not effectively disclosed in government information disclosure applications,which is fundamentally caused by the lack of examination by the administrative organs themselves.Therefore,it is particularly necessary to standardize the review of various internal documents of administrative organs.First of all,it is necessary to make reasonable use of the principle of interest measurement and the principle of separability to distinguish and deal with the specific content of the document.Secondly,it is necessary to improve specific review standards,strictly target the content recorded in internal documents,and clarify the effectiveness of the review in law.The administrative organ shall not easily decide whether to disclose or not disclose documents that have not been examined.At the same time,the higher authorities shall regulate the discretionary power of the lower organs.In this way,a relatively complete review mechanism will be constructed to realize the effective disclosure of internal documents as a process of government information under the premise of ensuring administrative efficiency.
