In the digital era where data is the core production factor,large platforms,with their unique capital advantage,technological advantage and talent advantage,use data to make profits,which to a certain extent negatively affects market competition,enterprise innovation,consumer interests and individual rights and interests,and brings great challenges to them.Under such circumstances,we need to consider the social consequences of platform data monopoly,improve the legal response,and promote the change of legal regulation of platform data monopoly in order to achieve the contemporary transformation of anti-monopoly law.Firstly,it describes what data,platform data,and platform data monopoly are,and then describes in detail the dual legal attributes of data and their importance,as well as the legal attributes of platform data monopoly that are closely related to them,and finally reveals the problems and challenges brought by platform data monopoly.The second part of this paper describes the realistic causes and harmful consequences of platform data monopoly in detail.It then discusses the legal responses to the problem of platform data monopoly in foreign countries,and finally transitions to the innovative exploration of the new problem of platform data monopoly in China and its shortcomings.The third part of the paper focuses on the regulatory changes of platform data monopoly.The main focus is on the activation of basic principles,the definition of conceptual scope,the identification of legal interests in data,and the definition of relevant markets,discussing the method of change one by one.The fourth part of the paper,based on the third part,elaborates on the transformation of antitrust law in the digital era.From the revision of the purpose value to the reconstruction of the rule system to the reorganization of the procedural mechanism,and finally to the general shift.
