Research On The Criminal Compulsory Medical Treatment Procedure In My Countr

China’s "Criminal Procedure Law" has added provisions for criminal compulsory medical procedures,introducing criminal special procedures for dealing with such issues as mentally ill patients who are not criminally responsible.The increase in this provision has made the mental patients in my country obtain legal basis on the application of criminal mandatory medical procedures.However,China’s criminal mandatory medical procedures still have some shortcomings in practice: the current conditions and targets of criminal mandatory medical procedures in China are not perfect,the scope of the main body of the start is too narrow,and the specific trial procedures are not specific enough.The procedures are not clear enough,and the supervision and relief mechanisms are not sound enough.Therefore,it is necessary to further supplement and improve the relevant laws of the criminal compulsory medical system to better guide the relevant judicial practice.According to my country’s national conditions and foreign experience,it is necessary to further improve the applicable objects and conditions in the future,appropriately expand the scope of the main body of the start,further improve the trial and execution procedures,and at the same time ensure that there is an efficient supervision and relief mechanism.
