Taking the fast lane of the booming economy in the age of big data,many traditional economic crimes are constantly taking on new forms.Pyramid selling is one of the first pyramid selling crimes that occurred in the real society.The criminals gathered to establish organizations and infringed on the safety of people’s lives and property by brainwashing and even controlling personal freedom.But in recent years,the strong presence of the Internet has changed this traditional criminal form,More and more pyramid selling actors carry out criminal activities with the help of the network platform,and a series of large-scale online pyramid selling cases are also frequently exposed in the public cause,which is the warning signal of pyramid selling activities moving towards the network.Once they are allowed to develop,the speed at which such criminal acts gather wealth and damage the social and economic order will be immeasurable.This paper starts from the identification problem caused by the classic cases of online pyramid selling crimes,To study the problems existing in the identification process of such cases,and try to provide some ideas for the innovative identification of network pyramid schemes and the comprehensive management of pyramid schemes in today’s increasingly renovated network pyramid schemes.This paper will be divided into four chapters to carry out the research on the identification of network pyramid selling crimes.The first chapter clarifies the development context and basic concepts of network pyramid selling,and combs the whole process of network pyramid selling from its emergence to its growing maturity based on the development time.On this basis,it summarizes the characteristics of network pyramid selling behavior and its differences from traditional pyramid selling behavior,and emphasizes the huge harm caused by network pyramid selling behavior to society.The second chapter searches for the judicial practice cases related to online pyramid selling by means of keyword search through case analysis with the help of online databases such as China Judicial Documents Network,and discusses them in categories from the dimensions of charges,time,space,and behavior patterns involved in online pyramid selling,so as to clarify the difficulties and pain points in identifying such acts in current judicial practice.The third chapter puts forward the specific problems existing in the current identification of online marketing behavior on the basis of case retrieval analysis.First,it is indistinguishable from other illegal behaviors,mainly including We Chat merchants’ selling behavior,illegal business behavior,and illegal fund-raising behavior.Second,there are problems in judicial recognition,including the concept of online pyramid selling behavior to be clear,the payment method of online pyramid selling to be clear,and the identification of fraud behavior in online pyramid selling to be strengthened,Finally,there are deficiencies in the current legislation on online pyramid selling and the parts that need to be improved and supplemented,which need to be responded urgently.On the basis of the above analysis,the fourth chapter,based on the existing laws and regulations and judicial interpretation,combined with the new situation of the development of online pyramid selling,gives targeted solutions to the problems raised in the previous chapter,mainly in distinguishing the boundaries between online pyramid selling behavior and other similar behaviors,further clarifying the rules of judicial practice identification,and improving the legislation of online pyramid selling behavior.
