| Since the Treaty of Rome,the process of European integration has been characterized by the continuous expansion of geographical scope,the deepening and improvement of organizational functions on the other,and now the internal cohesion and external competitiveness of the EU are remarkable.The establishment and improvement of the labour rights protection system is one of the main achievements of this process,which has played an important role in achieving internal solidarity,social stability,economic development and a higher standard of living for citizens within the EU(EC).Today,how to effectively protect labour rights is still a core issue on the EU’s agenda.Over the years,the EU(EC)has made achievements and accumulated experience in protecting labor rights.Protecting the labour freedom of movement is an important part of labor rights’ protection,which is the research object of this paper.Taking the European integration process as the background,this paper takes the problems and responses faced by the EU(EC)to protect the labour freedom of movement as the research clue.This paper reveals the motivation and basic experience of the EU’s achievements in this field by analyzing the initial motive,legal basis,scope of protection of the EC(EU)for establishing the right to free movement of labour,and resolving the differences between member states.On the one hand,this research will help us to have a deeper understanding of the forces and operation mode of EU integration through this perspective,on the other hand,the experience accumulated by the EU in the protection of labor rights has important value and reference significance for solving the problem of the protection of labour freedom of movement,which caused by economic globalization and regional integration.And also can help us to solve the the problem of protection of the free movement between different regions within a country.This paper examines in four parts how the EU(EC)guarantees the right to free movement of labour.The first part reviews the origin and development of the labour right of free movement in the EU(EC),and analyzes its legal systems to protect labour right of free movement.The subject of this rights have become wider,the rights have become increasingly enriched and gradually by legal protection,and gradually developed into the basic rights of EU citizens.The second part examines how the EU(EC)solve the problem of the lack of rights protection,which due to differences in social security systems among member States.The third part focuses on negotiations and compromises between member states on the protection of labour right of free movement during the EU eastward enlargement,and also focuses on the impact of the establishment of transitional restrictions on the protection of labour right of free movement.The fourth part mainly analyzes the challenges and responses faced by the EU in the protection of labour right of free movement before and after Brexit.The EU(EC)has made creative achievements in its efforts to guarantee the free movement of labour for decades.The initial motivation was to build a unified market,develop the economy and ultimately achieve lasting peace in Europe through economic integration,which as it deepened and expanded,the EU recognized the guarantee of the free movement of labour as a fundamental human right and made clear in the Lisbon Treaty.Thus,practical interests and values are the main motivators for the EU(EC)to guarantee and improve the labour right of free movement,adhering to principles and being flexible are the principles.Depends on this principles,EU properly handles the contradictions arising from the differences in social security systems and interests of various countries,therefore the EU have been maintained harmony,social stability,economic development and a high standard of living for citizen.Although there will be various challenges in this area in the future,the EU labour right of free movement is firmly rooted and the direction is clear.It is believed that the EU should be able to effectively respond to challenges on the basis of adhering to the basic code of conduct of principle and flexibility. |
