| Land is a valuable natural resource and asset,an indispensable means of production in the material production activities of human society,and one of the most valuable assets of farmers.General Secretary Xi Jinping once emphasized that land transfer and various forms of large-scale management are the only way to develop modern agriculture,and are also the basic direction of rural reform.As our country’s economic and social development and deepening of rural reform have entered a new stage,strengthening the basic status of agriculture has become the focus of the current and future work of the Communist Party of China and the country.Therefore,it is particularly important to speed up the circulation of rural land in our country,which is an important method to promote the development of our country’s agriculture.In 2004,the State Council promulgated a decision on deepening reforms and stricter land management,clarifying that "the right to use construction land owned by farmers collectively can be transferred in accordance with the law." The country has introduced the policy of rural land circulation in order to concentrate the limited cultivated land resources and make full use of it,so that the land can exert the highest value.In the past two decades,although the rural land transfer has made significant progress and achieved some success,there are still some problems to be solved,such as,how to improve the land transfer system,how to promote the orderly flow of procedures and how to ensure sufficient transfer funds.These "three difficulties" restricts the development of rural land circulation.By solving the "three difficulties" of rural land circulation,we can improve the utilization rate of land and accelerate the modernization of agriculture and rural areas.In this paper,through the use of collaborative governance theory,meta-governance theory and land property rights theory,using case analysis,literature analysis,interview investigation and other research methods,in-depth analysis of the specific measures of Pengshan District Government in cracking the "three difficulties" of rural land transfer,the reasons for success,the effects and so on.The study found that the measures taken by Pengshan District are representative,advanced and enlightening by promoting the "three-party coordination" to crack the imperfect circulation system,implementing the "four-step mechanism" to crack the non-standard circulation procedures,and revitalizing the "two-rights mortgage" loan channels to crack the lack of funds.Based on the above research,the author believes that the problem of rural land transfer in China is still prominent,and there are still many thorny problems that need to be solved urgently.These need the government,departments and social integration resources to work together to solve.First,the government should continue to increase support for rural land transfer,so as to coordinate the relevant departments to establish a rural land transfer mechanism combining planned regulation and market.Second,the relevant departments should improve the legal mechanism of land disputes.Relevant departments should set up specialized agencies such as land dispute arbitration and mediation in villages,towns and districts step by step,and equip professionals to serve the farmers and protect their legitimate rights and interests.Third,the society should increase the publicity and guidance of farmers on rural land transfer,and improve the enthusiasm of farmers to participate in land transfer.By analyzing the case of this paper,the author tries to provide some research support for the orderly promotion of rural land circulation in the future. |
