| With the approval of the amendment to the Land Administration Law of the People’s Republic of China,the legal barrier of collective construction land entering the market has been broken,and the dual management of urban and rural land has been broken.The main effects of "the three land reform" have been legally reflected and promoted throughout the country.This paper first briefly describes the background,research results at home and abroad,and related concepts of the entry of collectively operated construction land into the market.Based on the theory of land property rights,land rent theory,and the new public service theory,Luojiang District,Quanzhou City is selected as the research object to analyze the problems and causes of the management of the entry of collectively operated construction land into the market in this area,mainly including: The lack of attention,publicity and confidence leads to low awareness and participation;The implementation of the new regulations is not in place and the construction of supporting systems takes a long time,leading to the imperfect system;The confirmation of land ownership has not been fully completed,and historical reasons such as policy change and administrative region change,leading to unclear land property rights;The outstanding problems left over by history,the pursuit of interests,and inadequate supervision lead to the existence of an invisible market;There are no clear provisions,violations and violations of construction,leading to disputes in the definition of the market entry scope;Lagging land management,lack of standardized land use,and insufficient control led to low efficiency of land use;The game among interest subjects and the lack of distribution mechanism lead to uneven distribution of income;The lack of system,talents and market leads to the simplification of the market entry mode;The lack of special management institutions,inadequate supervision and management equipment,and difficult handling of historical problems have made it difficult for the government to manage and supervise.After learning from the experience of Wujin District,Changzhou City in Jiangsu,Beiliu City in Guangxi,Deqing County in Zhejiang and other typical pilot cities,this paper puts forward the countermeasures for Luojiang District to implement market entry management:strengthen the main force of implementation,increase the publicity of laws and policies to improve the awareness rate and participation;To strengthen the top-level organization design and scientifically formulate the implementation system to improve the market entry implementation system;The land property right should be clarified by perfecting land use planning and land confirmation system;We should guard against the invisible market with flexible system improvement and rigid punishment and governance;Respond to the dispute on the market entry scope by defining the market entry scope of stock and increment;Improve the efficiency of land use by invigorating the disposal of inefficient idle land and promoting the reform of "three pieces of land";To promote the reasonable distribution of income by defining the object of income distribution and establishing the income distribution system;Promote the diversification of market entry modes by expanding market entry modes,channels and purposes;Strengthen government management and supervision by establishing service system and supervision system. |
